The judicial system can block it too. If the legislative branch gave the power to a federal agency to regulate that area, the legislature would have to change the law (with POTUS signing) to change that. Do federal agents have the authority to publicly stop and detain people on probable cause? Other than trafficking or possibly large growing operations, aren't the feds 100% dependent on state and local law enforcement to actually catch marijuana users and forward the cases to federal jurisdiction? I can't imagine the FBI or DEA having the resources to police simple use around the country...

There are already several cases litigating this particular issue in 18 USC 922 - at least one of which came down striking the law - and more are awaiting a decision. His case probably won't be the deciding case.

I am not a lawyer, and never pretend to be one, but can someone explain how states can pass laws that are clearly contradictory to federal law? They didn't. Federal law prohibits cannabis possession, use, growing, etc. State law did too - that's now been repealed. There's not a federal law that say...
