I read everything offered a number of times. There is nothing clear about your posted statute, in particular the offering in red. How does it tie to the statute jdege pointed out?

Minn. Stat. 609.66
Subd. 1f.Gross misdemeanor; transferring firearm without background check.

A person, other than a federally licensed firearms dealer, who transfers a pistol or semiautomatic military-style assault weapon to another without complying with the transfer requirements of section 624.7132, is guilty of a gross misdemeanor if the transferee possesses or uses the weapon within one year after the transfer in furtherance of a felony crime of violence, and if:

(1) the transferee was prohibited from possessing the weapon under section 624.713 at the time of the transfer; or

(2) it was reasonably foreseeable at the time of the transfer that the transferee was likely to use or possess the weapon in furtherance of a felony crime of violence.


A non FFL holding citizen can or can not sell a hand gun in Minnesota face to face without the purchaser producing a PTP or PTC WITHOUT consequence or further sale document filing with law enforcement? This would require a tie-in with all applicable statutes regarding the LEGAL face to face sale of a hand gun. In Minnesota. By a private citizen to another non-prohibited citizen.

It's about as clear as mud.

Did I miss that conclusion in state statute, or is it assumed that as long as it isn't specifically prohibited , it is permissible?


MN 624.7132 does not apply to a transfer by a person other than a federally licensed firearms dealer (MN 624.7132 Subd 12 (1)) -- and since the behavior is not prohibited, it is therefore legal.

This question and the ensuing circle jerk seems to come up every few months.

Non prohibited, non licensee persons may buy, sell, trade, swap at will. There is no requirement to produce or ask to see a PTC or PTP in private transactions. If you (as a seller) see buyer's driver license (to validate same state residency requirement) and ask the person if they are prohibited from taking possession/owning firearms, AND they reply in the negative--you are good to go. Anything else/more is purely a matter of feeling comfortable.

Thank you. I wish the state of Minnesota would spell it out as simply as you have. I suspect the circle jerks would end if some clarity were used to straighten out the can of worms that serves as a guide for citizens. It might help if you saved your post, and simply offered it up to the next chump that is interested in firearms, but does poorly with Chinese puzzles.

BTW. Nice little show at Pipestone today. Maybe sixty tables and a steady flow of browsers. Every vendor I visited with claimed sales were excellent, and the proof was in the items going out the door. I sold off a 6" blued Colt Python and a S & W Model 34 4" blued. It was about a 90 mile round trip on a one-lung motorcycle, sunshine and mid 50's out there on the Buffalo Ridge. All in all, it was a pleasant day.
