In the MNGPAC survey earlier this year NVD was one of the items to prioritize for them to work on. No idea how it turned out. I'd likely have a nice thermal scope and PVS-14 now if I could legally use them.

"A person may not possess night vision or thermal imaging equipment while taking wild animals or while having in possession, either individually or as one of a group of persons, a firearm, bow, or other implement that could be used to take wild animals"

That last part is might allow LE to enforce this on any weapon that "could be used to take wild animals".
