Based on his performance as Senator, I'd say that there's a high likelyhood that Dayton would wet himself and hide under his desk shortly after taking office, then loose interest and decide not to run for a 2nd term, all while delegating things for the remaining 3 or so years of his term to the Lt Gov.

Because Marc Berris' time ain't free. Sure, you'll recoup if/when the denial is overturned, but you still need to tie up a fistful of cash in the meantime. Furthermore, while Marc Berris is very good, there's no guarantee you'll win...or get your money back from the county.

That'd be my guess.
