I'm willing to trust the justices on the SC more than this guy. His "ratified by default" position is one I've never heard of, flies in the face of common sense, and he's provided no basis for it. But nice red herring.

Sorry for the late response, I've been out of town.

Morris may not be a Constitutional scholar, but he is a political insider and as such has a good idea of the goings on in Washington and the current administration.

As I read the Constitution I would say this move would be unconstitutional, Vienna Convention or not. However, unlike Heffay I have no faith that a majority of the nine justices who now rule us will see it that way.

I guess we'll find out on July 27th when Mrs. Clinton is scheduled to sign the treaty.

We've signed treaties in the past with the UN such as the UN Convention on the Rights of the Child without ratifying them so even if it is signed I really don't see anything coming of it. The UN is a joke of an organization anyway with no real capability or will to enforce anything even if it is their stated purpose. Just look at the wrangling of the definition of the word genocide during the Balkans for a great example on that.
