HF241 and the Garand

I'm confused reading the proposed banned-rifle description in HF241:

(1) semi-automatic rifle that has the capacity to accept a detachable magazine and
2.31has one or more of the following:
2.32(i) a pistol grip or thumbhole stock;
2.33(ii) any feature capable of functioning as a protruding grip that can be held by the
2.34nontrigger hand;
2.35(iii) a folding or telescoping stock; or
3.1(iv) a shroud attached to the barrel, or that partially or completely encircles the
3.2barrel, allowing the bearer to hold the firearm with the nontrigger hand without being
3.3burned, but excluding a slide that encloses the barrel;

First, does a M1 have detachable magazine? I know we would say that it has an internal magazine, but is someone with a badge, who is not a Garand owner, going to call the clip a removable magazine?

Second, does "a shroud encircling the barrel" mean any riflestock forend?

The author may not have intended it to, but the language in the bill looks like it would include any forestock.

Which means it would include pretty much every rifle manufactured in the last 140 years.

It would appear that the 7-rd limit was chosen to specifically capture the M1 Garand as a banned rifle.

Pure genius. I can't think of a better bill to explain "unintended consequences" to high school classes all over the state. Awesome! I'm going to call the authors to congratulate them. :poundon:

Unpossible. The FBI expert testified that they only want to take away the more powerful/deadly .223 guns. I recall him saying something along the lines that the .30 cal guns are less lethal. I could be wrong though. I may have missed some of his testimony as I was busy pounding my head on my desk.

That smaller .223 bullet really gets in and rips things up compared to those clunky bigger calibers. I'm surprised they aren't using it for elephants in Africa yet...

No, that is what he said. I couldn't believe the stupidity coming out of his mouth.

I think the real reason the 7 round number was picked wasn't to nail the Garand, but rather to copy New York. And by default, they get an added bonus of banning almost every handgun - only the smaller single stacks and the older designs (1911) are safe.

Dang, I just realized that the uber modern C.96 Broomhandle Mauser pistol would be banned too with its high capacity fixed magazine.

Yeah, this language also bans most tube-fed semi-automatic 22LR rifles as well, like a Marlin 75C or 60. Gotta watch out for those.

Unless you can find one that only holds seven rounds, I'm pretty sure it bans them all.
