Senate gun control bill passes 65-33

The " do something " crowd couldn't resist.

The house will pass it in a heartbeat. The redflag law lack the burden of due process, I'm confused and upset. Supreme Court kicks ass and the Senat ******* the bed......

While I don’t like it either, I does not contain a red flag law. It encourages states to do so. So depending on your state it could contain due process or even not exist at all. The fight is not over.

Yeah, I know a case could be made that I am lazy and I need to do my own reading/study/research but I really appreciate it when folk break stuff down and explain stuff to me in words I understand. Several people do this on this site and I thank them for doing it.

True enough but I suspect a state like say South Dakota might be smart enough to pass a law that gets them the federal dollars but really changes very little.

MN on the other hand will be chomping at the bit on this one, good thing Rob and Bryan are standing guard.

First bullet point talks about ammunition, does this mean background checks now need to be done for every ammo purchase?

Second bullet point talks about needing FFL licenses. What is “repeatedly”? I thought ATF already has a definition of when an FFL license is required. And that they are also aggressively revoking those licenses when they get a chance.

I have heard claims that this bill constitutes something of a stealth attack against the gun control crowd by a handful of savvy GOP senators, taking advantage of the Dem's desperate need to get something passed.

Hence funds for state red-flag laws - but only if said laws have meaningful due process protections.

I've been uncertain.

But with respect to the FFL requirements - BATF has always refused to establish fixed rules for what is or is not "engaged in the business", so as to allow themselves maximum flexibility with respect to how they might bring charges against.

This new law contains:

Section 921(a) of title 18, United States Code, is amended— (1) in paragraph (21)(C), by striking ‘‘with the principal objective of livelihood and profit’’ and inserting ‘‘to predominantly earn a profit’’;

[...]

(22) The term ‘to predominantly earn a profit’ means that the intent underlying the sale or disposition of firearms is predominantly one of obtaining pecuniary gain, as opposed to other intents, such as improving or liquidating a personal firearms collection: Provided, That proof of profit shall not be required as to a person who engages in the regular and repetitive purchase and disposition of firearms for criminal purposes or terrorism.

Even Komifornia has had that struck down so they can no longer require background checks for ammo purchases.

I think you are mistaking what passes for reporting today to be accurate.

But IL can require a FOID card that in turn required a background check… right? I realize that may not trigger background check for every purchase, but the end result is one cannot just walk into a store and buy ammo.
