Read the judge’s order.

The fact that we waited so long to bring the case up also was cited as a reason to deny the injunction. They have a point.

Yeah, injunctions are basically emergency orders, and since they usually amount to prior restraint the bar is set very high.

I am listening to live on patrol, the Ramsey County Sherriff stated (provided I heard him correctly) that the State Fair was getting it’s own police. Is this a result of the lawsuit, will it effect the lawsuit?

I would suggest that once the Fair got the bill for the County's services they re-evaluated their policing....that and from what is rumored, the county board of commissioners weren't to keen on having the county involved.

Not sure how it may effect the lawsuit

We're unsure if it was a result of the lawsuit, but it is happening.

The only impact on the lawsuit is that we voluntarily dismissed Ramsey County and the Ramsey County Sheriff from the suit since they were no longer providing law enforcement services at the fairgrounds - and it would have been really difficult to win given their revised circumstances.

Remember when the Minneapolis Park Police wouldn't accept state preemption and tried to ban carry from parks? Independent police seem to be particularly prone to opposing carry.

There's no indication that's the reason - the federal courts are extremely backed up and criminal cases get priority. The judge may also have been waiting on the Bruen decision, which just came down 6 weeks ago.

Our attornies in this case have another case before this judge that has been waiting even longer, so we don't think it has anything to do with the timing of the fair.

Press Release: Judge Tunheim rules against MN Gun Owners Caucus in State Fair case

Our lawsuit against the Minnesota State Fair was dismissed today in the Federal District of Minnesota.

Judge Tunheim ruled that the Fair’s ban on the lawful carry of firearms by permit holders satisfies strict scrutiny because the fair is a “sensitive place”.

Minnesota statutes specifically prohibit local government entities from establishing firearm regulations or restricting the lawful right to carry. The Judge did not address this issue but rather found that Minnesota’s preemption statutes do not give private individuals the right to sue over these actions.

In his ruling, the judge failed to apply the standard established by the US Supreme Court in the Bruen case.

We will be reviewing this decision and our options for appeal with counsel over the coming weeks.
