Title 10 Chapter 13 of US Code and 2nd Amendment

Everyone argues about the militia part of the 2nd amendment but I have never heard anybody bring up Title 10 Chapter 13 of US Code. It states:

"The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard."

Does this section have any relevance?

SO does that say ONLY females in the National Guard and ALL males 17-45 qualify....?

Since myself and a number of others on this board do not fit in either the 17-45 male age group or as a female in the National Guard, well I kind of hope that it doesn't apply, especially if SCOTUS decides that the 2nd is a collective right and only applies to militia and uses this definition.

On the other hand, the 2nd should stand with what it says as a individual right-the right of the people, and treated the same as the other Amendements:

Amendment I:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.


Amendment II:
A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

But then again I didn't sleep at Holiday Inn Express last night................. :roll:

No, those are the only ones required to be militia. The libs would love to take our guns and give us only shotguns, that way if needed they could shoot us from a distance would could not defend against with a shotgun. One has to remember what happened right before the constitution was written....a War of independence! HELLO, that is why the citizens have the right to keep and bare arms and that right shall NOT be infringed, because if we ever got another tyrant, or tyrants in controll of our government, we the people would have the ability to replace them.

Right now, we shoot them with VOTES! :-) but when we back up and take a close look....are our votes Blanks? After watching the primaries, I am under the impression that the media and picks our candidates. they pick the one they want...ROMNEY and then verbally shoot down any one who gets close to their baby. What they say about the other candidate does not have to be valid, just has to make people think it might be and the challenger is destroyed politically.

Personally, I would not trust a liberal as far as I could spit them. And I dont trust many republicans either. The more conservative they are, the more I trust them. But the GOP is controlled by left leaning repubs and RINOs (republicans in name only).
