Confiscated;Bloomington PD refuses to accept Permit to Carry

To keep it breif and to fill in those with some insight, roughly 2 months ago my vehicle was stopped by several squads in downtown Minneapolis after an officer noticed my Glock 27. Long story short, I was leaving a late dinner at Manny's with a coworker, about to head to uptown to consume a moderate amount of alcohol, and personally refuse to carry a firearm when I do. As a valid permit holder, at a red light, I cleared my weapon and placed it in the center console of my vehicle when my coworker/passenger asked to see the gun (cleared gun & he was not a ccw permit holder). Without brandishing it or pointing it at anyone, he aimed the slide open gun at the dashboard and activated the laser grip. The officer saw this, right place and right time, and they proceed with guns drawn to what they thought was a felony arrest.

After realizing what the real situation was, and spending 30 mins in a squad, we were let go but my Glock was taken into Bloomington PD, where the Sargeant leading the stop was from, to be released later. No charges were filed.

Bloomington PD now says they refuse to let the weapon be transferred back to my name and released to me without a valid PERMIT TO PURCHASE; they refuse to recognize my CCW permit to release my gun. After being a ccw holder, I can walk into any gun shop and take something home that day, as you know, and I've jumped through more hoops to get that permit than a purchase permit. Is this legal for them to do? Seems like they are trying to stall me for some reason...

Lastly, I reside in Ramsey county, and went along with BPD's demands and filed for a new permit to purchase anyways; I just want my Glock back. However, it's been 41 days to the date and I have yet to hear anything on it. I have called the sheriff's office and was told it's "sitting on the commanders desk waiting to be signed". Aren't they required to give an approval or a valid reason of declination within 30 days?

The time frame for a Permit to Purchase is actually 7 days - though that seems to be ignored on a regular basis, and there is virtually nothing you can do about it. Mine took over 60...

IMHO They're dicking with you because you were a dumb@#$... Jump through the hoops you need to or get a lawyer.

laywer up and then go after the city to recoop the costs, should be a pretty simple one.....If that's the whole story.

That part of what he said, IMHO. I am not a lawyer, but I don't see how they can require you to get a P2P in order to get your legally owned firearm back. If a P2C was sufficient to purchase the gun, it should be sufficient for them to return it to you. Maybe I am missing some nuance in the law? :roll:

You're saying it is illegal to handle an unloaded handgun in public?



Possession of a uncased pistol in a motor vehicle without a permit (friend did this) is a gross misdemeanor.

An argument can be made (I'm admittedly NOT sure how strong the argument is) that the display of the pistol in the car shows poor judgment on the permit holder's part, and may demonstrate that he is a risk to himself / others.

Handling or displaying a weapon in a operating vehicle could probably get you cited under either of these two city ordinances:

(e)The reckless handling or use of a dangerous weapon so as to endanger the safety of another.
(h)The aiming of any dangerous weapon, whether loaded or not, at or toward any human being.

Were cars in front of you or to the side? Your friend activated the laser which probably violated a boatload of other statutes.
