California Handgun-Microstamping Law Upheld by U.S. Judge

Postby LarryP on Fri Feb 27, 2015 7:51 pm

(Bloomberg) -- California’s ban on new semiautomatic handguns that don’t stamp identifying information on the cartridge was upheld by a U.S. judge in a major loss for gun-rights groups.

The law barring sales of handguns without the microstamping technology doesn’t violate the U.S. Constitution’s Second Amendment because gun owners don’t have a right to buy specific types of firearms, U.S. District Judge Kimberly Mueller in Sacramento said in her ruling.

“Plaintiffs insist they have the right to determine the precise way in which they would exercise their Second Amendment rights,” Mueller said. The insistence upon particular handguns falls “outside the scope of the right to bear arms,” she said.

The judge apparently missed that "shall not be infringed" part.

You expect a different decision from CA Judge?

I hope the ghost of Michael Paymar and his cronies in the Legislature do not try to stuff something like this down our throats now.

That's what I was thinking.

It's a really confusing ruling, because it doesn't make any sense.....
“The court’s ruling means that more gun crimes will be solved, more lives will be saved, and California communities will be safer,” Mike Feuer, the Los Angeles city attorney and the author of the microstamping bill, said in a statement.

What do you mean. Every jack booted thug that get his gat at the local gun shop will be easily traced. Thus saving lives and stopping crime.........easy peasy. When will CA fall into the ocean and become a memory.....

Unfortunatly the plate California is on, is more rotating than moving out to sea. So it is heading toward Alaska.

I still like the idea of selling it to China to pay off the debt we have!

Yeah, ok Kim. FYI, ANY requirement for exercising an inalienable right is an infringement. But one that strictly regulates which firearms can be bought and sold, and at significantly higher prices, is clearly unconstitutional.

To hear the would be gun grabbers and banners talking about this is infuriating. They know nothing about firearms, but their uneducated positions are given a platform. I wish I had a nickel for everyone who thinks the actual projectile is stamped. Once informed its only the case, and shown a picture of a revolver or a brass catcher, along with how easy it is for a criminal to file off the stamping die, they don't have much to say. Except maybe, "but if it saves just one child". I truly hate these people. And when I say hate, I mean a deep seated, burning hot hatred.

A sure way of escalating this argument is to bring up the fact that abortions outnumber gun crimes and the uterus is a dangerous place. :D :D They will go nuts on you. Guaranteed!!!!!

How about they make a tool roster so only approved tools made out of a metal that doesn't exist can be used to perform abortions? Or maybe California will only have approved versions of Bibles that meet their guidelines be allowed for sale. Slippery slope and all that.
