Can AR-15's be turned into NFA items by executive order?

Scary if true and Biden is elected. The following is quoted from the Gun Discussion forum of quora.com:

Yes. Much tougher.

One of the things on Biden’s website is that he intends to make “assault weapons” and “high capacity magazines” NFA items.

The 1968 GCA says the ATF gets to decide if something is “sporting” or not, and can add weapons to the list without Congressional approval. They did this years ago with the Street Sweeper.

So, Biden can sign an Executive Order telling the ATF to do so. His website says there’s an amnesty period during which you can jump through the NFA paperwork and pay the $200 tax per item (gun, each magazine)

Seems there is even more chatter regarding the BATF threatening to classify AR15 pistols (Stabilization Brace or not) as illegal Any Other Weapons. Does anyone know if this is true or potentially true?

Still allowed in my neighborhood. Guns to for now. Of course when the neighbors let of a jar of tantrite that got some attention :twisted:

Yep; the ordinances are pretty standard, and universal; slingshots, air rifles, archery equip- only allowed at authorized ranges in Mpls, StP, most suburbs.

Given how many of them are in circulation, it seems implausible, but even if they were classified as AOWs, it wouldn't make them illegal - it would make them subject to registration under the NFA. The ATF would just be burying themselves under a mountain of paperwork if they did that.

How many million are out there.......
they may get a few to confiscate and burn,
they may make an example of a couple of owners,
but in the long run that would not turn out well for the suits.............

Biden may try that, but I don't see how it avoids getting challenged. On some level, any AR, whether pistol or rifle configuration, fits the "common use" language of the Heller decision, so outright confiscating them would seem to be legally iffy, at least from my not-a-lawyer perspective.

It will take time to pack the court if he tries it. You can bet this will go all the way to supreme court when challenged. Don't think it will stand.
