HJ Res. 44 passes!

Postby Lumpy on Wed Jun 14, 2023 11:53 am

The House narrowly (219-210) passed a resolution overturning the Biden pistol brace ban. Off to the Senate. Does anyone know how the prospects look there?

Maybe.

But Biden will veto it.

Passing a law requires consent of House, Senate, and POTUS.

Executive branch regulations have the force of law, unless Congress objects.

Fine.

But that should mean - but doesn't - that the regulation is blocked if any one of House, Senate, or POTUS objects.

Remember DeMorgan's law.
The negation of a conjunction is the disjunction of the negations.

The judicial system can block it too. If the legislative branch gave the power to a federal agency to regulate that area, the legislature would have to change the law (with POTUS signing) to change that. Fortunately we also have the courts to provide additional checks and balances.

It does send a message to the Judicial system. Of course that doesn't matter to leftist judges.

It actually has been blocked in multiple federal appellate cases for the time being.
