I would really like to see this statute or exception to the statute for LEO's to carry during the course of their duties. I have looked and found no such thing, that is why I ask.

I'm sorry, I was referring to the Federal law ( 15 U.S.C. §§1241-1245 ). Although it's common knowledge that on the state and local level, most police departments (and even some EMS and Fire) simply don't care if their officers carry auto knives or even approve them as standard duty equipment.

Lawful by common convention. I really don't like it.

That is what I have discovered, basically turn a blind eye at the state or local level for LEO's and emergency personnel. Not trying to debate the merit of the policy, I would just like to see a statute or printed department policy based on a statute, court ruling or other legal decision. I have had this debate with more than a few LEO's and they truly they believe they can carry an auto knife and others can't under the law.

I assume there would have to be an arrest before there can be a prosecution.

Nahh, the cop COULD be served by long-form complaint. ;)

Personally I think they should all have access to auto knives (as well as the rest of us, for that matter). Seems like an auto knife could be more useful in extracting somebody from a car and things of that sort.

Don't get me wrong, I have zero problem with LEO's, EMT's or even the common joe carrying an auto knife. To me it is all an appearance issue, just like the assault weapon,,,, :? I mean a sport utility rifle and is no more evil or saintly because of it's cosmetic's.

I would just like to know the statute or exceptions if there is any. 8-)

Hmmm...say hypothetically I received one of these very blades as a birthday gift, and hypothetically carry it on a daily basis in my front left pocket, and just this week as I am reading this thread realized it is considered a controlled item?

It is a misdemeanor to carry a switchblade knife in Minnesota.

...staying with the hypothetical for a moment...could said Misdemeanor cause a person to lose their carry permit?

I never understood why people get such a hardon over switchblades when there are so many great legal options

Love this knife and have a Swiss Army that I can open almost as fast with my thumb...when I think switchblade I think of Happy Days and Grease. Doom on me...I'm certainly open to options?
