SBR information

This is how the ATF describes the process of applying to make an SBR. Buying an SBR is the same, except you use Form 4 instead of Form 1.

Prior to making a firearm, the individual must submit ATF Form 1 (5320.1), Application to Make and Register a Firearm, to the Bureau of ATF, NFA Branch, and receive approval. Form must be submitted in duplicate.

The applicant is to place, on each copy of the form, a 2-inch by 2-inch photograph of the applicant taken within the past year (proofs, group photographs or photocopies are unacceptable). The applicant’s address must be a street address, not a post office box. If there is no street address, specific directions to the residence must be included.

If State or local law requires a permit or license to purchase, possess, or receive NFA firearms, a copy of the applicant’s permit or license must accompany the application. A check or money order for $200 shall be made payable to ATF by the applicant. All signatures on both copies must be in ink.

Fingerprints also must be submitted on FBI Form FD-258, in duplicate. Fingerprints must be taken by a person qualified to do so, and must be clear and classifiable. If wear or damage to the fingertips do not allow clear prints, and if the prints are taken by a law enforcement official, a statement on his or her official letterhead giving the reason why good prints are unobtainable should accompany the fingerprints.

Forward the original and a duplicate of the completed application and appropriate tax payment to the Bureau of ATF, National Firearms Act Branch, P.O. Box 530298, Atlanta, GA 30353-0298.

If the application is approved, the original of the form with the cancelled stamp affixed showing approval will be returned to the applicant. If the application is denied, the tax will be refunded. Applications to make a firearm will not be approved if Federal, State, or local law prohibits possession of the firearm.

This is what MPD says on the subject:

I am a resident of Minneapolis. I am considering applying to Bureau of ATF to make a Short Barrel Rifle.
This would require me to submit Form 1, section 13 of which is "Law Enforcement Certification". (The form is attached)

What is the procedure for submitting this form and obtaining the certification?

You need to complete the form and bring or send it to this office; Police License Investigation Division, 350 South 5th Street, Rm. 1A, Minneapolis, Minnesota 55415.

First, we conduct research to determine if the weapon you want to make will be legal to possess in Minnesota under current State laws.

Second, if you possess a permit to purchase or a conceal carry permit in Minnesota and can show proof of the same then we conduct a brief recheck of your background to see that nothing has changed since the last background. Or, if you do not possess such permits, then we will have you complete in person a transfer/purchase application and then we will conduct a background check on you to determine your eligibility to legally possess firearms in Minnesota. This requires you to appear in person at our office. You will need current government issued picture ID showing you as a resident of Minneapolis. We will have you complete an application with various signatures to release information.

i love how Lt. Christopher Hildreth just said you need a Permit to Purchase a firearms or Concealed Carry Permit.
are you **** kidding me? Concealed Carry Permit?! he's a damn LT, he should know that it's a Permit to Carry a Handgun!! that's what's typed at the top of the damn things.

thanks Horseradish. i'm kickin' around the idea of an SBR. this is useful info

Pretty sure it is a permit to carry period. LT needs to brush up as well but... ;)

actually mine is marked permit to carry a pistol. guess that means no revolvers for me... :( haha

Also need one copy of the ATF Certificate of Compliance http://www.atf.gov/forms/download/atf-f-5330-20.pdf . It's also important to note that if you fill out and print either the online Form 1 or Form 4, they need to be printed on both sides of a single sheet of paper.

Building ("making") an SBR also requires that the firearm be engraved with the maker's name/city/state. Not required if buying one already manufactured by a licensed manufacturer - in that case it gets transferred on a Form 4 and engraving by the buyer is not required.

I Used Orion Arms for my engraving. Top notch service at a very reasonable cost.

Orion has an excellent reputation, but every time I need to get something engraved I price it at both Orion Arms (Lino Lakes) and Ident Marking (someplace in Texas). Orion always comes out more expensive for the engraving, shipping is more expensive, and Orion has to charge sales tax. Last time I did this it was for engraving a stripped lower in the trigger well. Orion wanted $65 + $14 shipping + sales tax. Ident charged by $45 + $12 shipping. I've been completely satisfied by the five engraving projects I've sent to Ident.

It's about time I get this sbr paperwork started. In central Minneapolis, where do I go and who do I talk to to get the individual (not trust) paperwork signed? I'm a little hazy on this, even after looking around. Do I call up any police station and ask or is there a central department I should go to?

Do you plan on building your SBR (Form 1) or buying one pre-built from a manufacturer Form 4? The latter makes for a somewhat more cumbersome process, but you can go to the "Class III" dealer (SOT) to buy the rifle and they can help you through the process, might even have the right forms sitting around.

It's unlikely that you'll get any information or help on the process from your local LEO and they certainly don't have the forms. IMHO, it's rare that anyone there even has a clue. The whole process is a Federal one - ATF NFA Branch.

First you need to get the blank forms. They can all be downloaded from the ATF website, or you can have them mail them to you. If you request, they'll also mail you preprinted fingerprint cards. If you download the forms and fill them out, be aware that both sides of the Form 1 or 4 need to be on the same sheet of paper.

You need to get fingerprints taken on the standard form FBI fingerprint form and marked with NFA Branch'es ORI number. You need to complete two copies of the Form 1, attach a recent 2x2 photograph to each, then take the completed form to your local chief law enforcement officer to be signed. That might be your local sheriff of the county where you live, or if you live in a city, your chief of police. There are a few other office-holders that might qualify, like a District Court Judge or a County Attorney, but you'd have to read up on that. It would be worthwhile to find out beforehand whether or not your particular CLEO would sign it...some do refuse.
