Can't quite seem to escape Chicago

So I recently applied for my permit to purchase. Recently being 2 weeks ago now. From everything I had read, I knew the city, St Paul in this case, had 7 days to approve or deny the permit. Well, the first week goes by and it doesn't come. Now the second week has gone by and I am getting upset. I called to get an update.

Well, apparently they cannot issue the permit until they hear back from the Chicago Police and the Cook County Sheriff. On the PTP application, it asks for your residences in the last 10 years. Well, I lived in Mpls for a year, Chicago a year, and a Chicago suburb before that. She said nothing can be done until she hears back from all police departments.

She has been waiting on Chicago and Cook County for over a week now. I was told there is nothing I can do to expedite the process, and that their request will be resent in a few days if they do not hear back. And then eventually a phone call after a month.

This is absolute bull.

IIRC the law says 7 days is a hard limit.

Print yourself a copy, go to the chief's office, and ask him to read it with you .

I applied with the St Paul Police. Should I have applied with the Ramsey County Sheriff instead?

Plan on 30 days for St Paul... It took forever for my permit. I was warned by a few others that it would take a few weeks and it did.

They were quicker to get my PTC than my permit to purchase, but I also was more knowledgeable of the law as well. Maybe they somehow knew that I was going to buy that Sigma, and were trying to save me some anguish?

I was in a similar situation a few years after I moved down here from North Dakota. In my case it took 2 months before they heard back from ND - apparently they sent it by Pony Express. Get a Carry Permit - then you only have to deal with it every five years.

If the law says 7 days, why are you allowing them to push it out to 2 months?

Subd. 5.Granting of permits.

The chief of police or sheriff shall issue a transferee permit or deny the application within seven days of application for the permit. The chief of police or sheriff shall provide an applicant with written notification of a denial and the specific reason for the denial. The permits and their renewal shall be granted free of charge.

It doesn't say anything about mandatory checking with other police departments. But does say that they are to do a NICS check. Reasonable effort to check other state or local systems, but that doesn't preclude them from going past 7 days.

Subd. 2.Investigation.

The chief of police or sheriff shall check criminal histories, records and warrant information relating to the applicant through the Minnesota Crime Information System, the national criminal record repository, and the National Instant Criminal Background Check System. The chief of police or sheriff shall also make a reasonable effort to check other available state and local record-keeping systems. The chief of police or sheriff shall obtain commitment information from the commissioner of human services as provided in section 245.041.

If they can't get that information off your provided drivers license, WHY do their job for them.

You are correct, sir, my bad. On one had it is kind of surprising that the RCSO got the PTC out quicker than SPPD can get a PTP, but I would think that the county (even Ramsey) knows that people who have taken a carry class from a good instructor actually might know something about the statutes.

Couldnt they just deny and then as the reason for denial failure of cook county to provide requested info.

Unless you have some reason to believe whatever attorney you call is going to dash off a letter to the PD for free, then there really isn't anything you can do to force them to issue the permit. It is not a matter of "allowing them to push it out to 2 months", it is a matter of the problem with the way the law is worded - there is no penalty to the PD for going past the clearly stated time frame, and there isn't a damned thing you can do about it.

I was told, on the 2nd or 3rd time I called, during the 60 some odd days they took for mine (St. Paul), that they could make a decision at that moment, but it would be to deny it, as they hadn't heard back from all the various jurisdictions in which I had lived over the previous 10 years. It is extremely frustrating, knowing that you are 100% in the right, and that it doesn't matter in the least to the folks in charge.

Turned out not to matter - I took my P2C course a few days after applying for the P2P, and the P2C came in 12 days... I'd suggest doing the same.

Seeing as how I am currently sans firearm (I had to sell them all when I moved to Chicago) I'd need the PTP first

If you talk to some of the instructors here, they have loaners for use in the class.
