Attorney for denial

Postby tomcat32 on Fri Sep 17, 2010 2:05 pm

Does anyone know a good attorney for a denial. My renewal was denied even though I have 0 convictions but ramsey county still denied me. Any help would be great. Thanks.

If you have an arrest record you might want to look at getting it expunged as well... now days it doesn't matter if you haven't been convicted.

+100,

I've had a student that was arrested for something, no charges were ever brought up against him police even apologized to him after the fact, saying it was their mistake. He ended up getting denied for the ARREST. Which is BS IMHO. They fought the denial, and won it in short order.

Have you looked at your record to see what they might be looking at? Do you have any restraining orders or mental health issues?

This might bear paying attention to. Some sheriff, jusding the law and looking at the data issued the permit. Now, the RCSO is denying the Renewal? Really? IF something had happened to make the person inelligible, wouldn't the prosecutor or Sheriff or Judge have demanded the surrender of the permit?

OR, is the RCSO using subjective criteria completely out of line with the rest of the state?

Speaking of Sheriffs and Judges, does anyone have a good rundown on the Sheriffs that are up for election soon? It would be nice to know who the complete tools are so they can be voted out of office:

Don't want to derail the thread, but unless tomcat32 posts again it's kinda dead anyhow. :(

Paul,

In the case of my student he was issued a permit to purchase, but denied a PTC about 4 months later. Infact upon talking to the sheriff he was informed by a deputy that he had to surrender his permit to purchase, and that "he should get all of his guns out of his house" (whatever that means). He was never charged with any crime.
Here is what they denied him for,
He was arrested for domestic abuse about 8 years prior but that was later determined to be in self defense. His wife (now ex) had attempted to assault him with a baseball bat, and he bruised her wrists in an effort to restrain her and flee his home. He had suffered 2 broke ribs a fractured skull and wrist. The police at the time even apologized to him after the fact saying that in those cases they always side basically with the wife. It wasn't until they had a doc check him out that they realized the extent of his injuries and got him medical attention.

I told him to call a lawyer immediately. One letter to the DA from a lawyer cleared it all up. He now has his PTC.

This was in RICE county btw... the denial occurred this year. The sheriff in rice runs all candidates he considers "questionable" past the DA. The DA decided in this case to deny the student.

I wasn't directly responding to your case Bessy, Sorry. I just went back and re-read what was nagging at me and it made me wonder.

I know I just thought you might be interested in the asinine criteria they can decide constitutes reason for denial.

Just an update. I put in a letter for reconsideration a few weeks back and just received my carry permit in the mail the other day. Thanks for all the advice and I'm set to go for another 5 years.

Did you write the letter personally or go through an attorney?
