Actually, it is. The only known time that an agency was keeping its own database was RCSO under Fletcher.

The statute is extremely specific on the record keeping aspect of this, and the BCA, love em or hate em, is very territorial over the information.

That's why we haven't seen a leak or release of the permit database to the media, such as happened in Iowa.

So your saying when officer pulled over my girlfriend (don't know the reason) she said he had mentioned to her about her carry permit even when she did not disclose the information to him.(she was not carrying at the time cannot carry on the reservation being a employee of the community not suppose to even have in vehicle)I think it was Eden Prairie or Shakopee LEO not sure though. I'll ask when she gets back.

The permit status has to be run separately. Yes, there are some departments and officers that automatically run it for every stop. Your girlfriend's stop may have involved one of those agencies or officers.

The single database provision of the statute was written to prevent the database from becoming public record by ensuring in statute that it is protected law enforcement information. This is a good thing. We don't want the database printed in the Strib. :shock:

Not sure what crystal ball that cop was using, but if he ran her by her name and DOB or DL he did not get back the information about the CCW permit. As it has been alluded to here, that information is stored separately. Of course it is easily accessible with another search, but it is an independent search from the basic query via name and DOB or DL. Not sure if cops can do it from their MDC or not, it probably depends on the functional compatibility with the state system.

What likely happened is that he asked dispatch to run her AND check for CCW. Not sure what would have triggered the officer to include the CCW query. Maybe it is part of the department policy?

I know of a local officer who says their personal policy is to request the Permit search on any car with a NRA or pro-gun sticker on it. I get the impression it's a test.
a) When the officer asks do you fail the LIE to me test?
b) When the officer asks do you fail the ATTITUDE test?

No attitude, straight forward, no nonsense, it's not a big deal answer can go a LONG way in helping the officer decide on the amount of discretion to use. YMMV

Well its definetly a good thing having seperate databases I just thought it was interesting how fast they did it. She said it was a shorter than usual stop being he came up asked for DL and Insurance went to squad came back within mins less than usall you all know how long takes if they want.I'm pretty sure now it was Shakopee and was for seat belt. (She got warning being first offense for anything.) I think it is kind of good they can see these things but at same time seems kind of uneccessary. Now that i think of it she did have Don't Tread on Me Sticker on front driverside window.

Its all making sense now.Image
