Wow. A simple question is turning into a big debate. I wasn't planning on attending this auction just an idea if the guns would be overpriced(i.e. Gander Mtn.)
I see this thread getting locked soon.

Considering it was his thread this comment does seem a bit rude. I would think if one wants to debate the merits of government then they would start a thread to do so rather than use a question about a gun auction to do so, but hey to each their own. I am wondering if you also consider it theft when they confiscate a person's vehicle on their third DWI?

There are consequences to people's illegal actions. Don't like it, don't break the law.

Many times the "guilty" party does not even own the property which is "confiscated" by the government. There is a good chance a bank "owns" the property, or the boat, firearm, or car is borrowed from someone else. In addition, many times this property is confiscated before a trial. Upon conviction, that is when someone should be fined.

Is there due process in the DNR confiscations? My understanding is that if, for example, a drug dealers cars, boat, and house are confiscated, there has been an order signed by a judge to do so and I would bet there is a process whereby one could fight it in the courts but IANAL. Just do not know what the DNR's lattitude is but is "seems" that they are allowed to put the cart befor the horse a bit, kinda guilty based on their assessment prior to any trial. Just saying, if that is the case, that is wrong IMHO.

I can understand consequences for breaking the law but if you have not been convicted then under what pretense do you state that the law had been broken at that point?

I highly doubt the dnr sells seized property before the case is resolved through the courts, but I could be wrong. I would think it would be just like criminal evidence, and after a court decision, if the property is deemed state property, then it goes to auction.

Did some googling. It appears that the DNR officer can seize it really at his/her discresion. Then if it is over $1000 they have to file a lawsuite to keep it. It appears that the lawsuite is heard by a judge but no jury and is seperate from any criminal proceedings, in otherwords it is possible that you could win in court the criminal complaint but still loose your stuff. I have not found what happens if it is under a grand (maybe they can just keep it?). Do not know and this could be wrong too, this is jsut what I found searching the interweb so...

Interested for any lawyers on here to comment.

That makes sense. And sounds like they have to follow due process just like LEO, and can't just nab your stuff & start peddling.
