The new boss' minions admitted to it when it was in front of the SCOTUS. It's my understanding that's how it made it out of there, the fee tactic wasn't working they called it a tax and "all was good".

Actually, there are a great many justices who did exactly that. The lifetime appointment gives them the independence to do so. Earl Warren is maybe the best example but there are plenty of them, including Kagan and Sotomayor. You don't vote against a president, you interpret the law as you see it. Sure, politics are involved but the constitution is the constitution -- Roberts proved that in his ACA ruling (though the taxation question was a real head-scratcher IMO).
