Question about shipping "High Cap" magazines

Postby 2beer on Tue Jan 22, 2013 3:03 pm

I'm sure this will put me in the brain dead category but. . . . I have a question. I listed some magazines as a lot on ebay. 5 total all are 10 round with the exception of one 15 round. They are for a Taurus PT92 I have someone that wants them shipped to NY, were they are illegal. I dont want any trouble, is it best to not sell or is it the buyers responsibility. I am thinking I might just pull the auction at this point.

IANAL, but I would't ship them to NY with their new law.

If retail stores (Cabela's, Midway, Gander Mtn.) specifically state "NO sales of high cap mags to NY, MA, CA, CT, etc", then I would think that's the LAW and I sure wouldn't do it.

I am reasonably sure that the state cannot charge you when you did not possess the item in their state. However, do you really want to open yourself to the potential lawsuit/fallout if the person receiving gets caught?

Personally? I will not sell or send anything firearms related to California, Illinois, all of New England, New York, etc. just to be on the safe side.

Don't do it. Plain and simple.

The government isn't forgiving when it comes to firearms or encryption. For example, with encryption, you cannot sell it to someone if you know they are going to sell it to a 3rd party. For example, if you sell a network hardware device to France who you know is going to sell it to China, and that network device uses encryption, it's a big no no. The thing is with the government, if you say "I didn't know, I'm sorry", they still slam you and do so even harder for NOT knowing. It's YOUR fault. The better answer is "I'm sorry. I made a mistake. It won't happen again."

It's just as bad, if not even worse with firearms, depending on the situation.

I also wouldn't send it to VA and have the guy pick it up from there because I would know he would be breaking the law and could be held accountable. It's just NOT worth the risk. Don't be a test case. Also, there's the political aspect of it because someone sending high-capacity magazines to someone in an area where they are illegal, does not serve that person or the gun community at large.

Do it. Just tell them you know David Gregory.

You cannot ship high capacity magazines to New York. HI and CA has law enforcement exception, but in NY, even that is not accepted.
