I suppose it depends on the nature of the contact. A protracted contact where the officer decides that , for her safety, she's going to "secure" the permit holder's pistol in her squad? IMO, the courts would uphold the running of the serial #. They would certainly uphold the officer disarming the permit holder in ANY case.

I can't see where running your handgun serial number is much different than running your license plate number, at least to a court.

My permit doesn't have my signature on it, why would they want to see how well I can forge John Gunderson's signature? ;)

They likely have your drivers license in their other hand.

Have you looked at your license lately? My signature on my license is less than a centimeter long, and is elongated vertically. It barely resembles my actual signature, which is usually about 4 inches long.

I guess I'm in trouble.

I look at it daily. Often several times a day.

I didn't write the law, I just know there is a provision in the law for a LEO to ask you for your signature if he wants to.

Exactly.

That pesky 4th Amendment that protects you from unreasonable SEARCH.

Driving a car isn't a protected Constituional Right....

My last traffic stop - the officer was less concerned about the loaded Beretta 96 than the 48 pounds of gunpowder in a box on the front seat upon which he rested his arm while looking thru passenger sidewindow of my truck. Pistol was on seat in middle of truck, well within reach. He only asked if I had a permit for the pistol-didn't ask to see it- did ask about the two target rifles in back seat and 600 rounds of 50BMG ammo after I explained my trip to NRA Whittington Center for FCSA World Championships.

Stopped for safety reason - I was eating an ice cream cone with my left hand while holding my cell phone with my right hand while driving 70 on Interstate 80 in Nebraska "Please drive safely and keep at least 1 hand on the steering wheel at all times, Sir."

Being old and gray does help sometimes.

Typically I offer my license and permit at same time, especially when not carrying. Reaction is worth noting.
While carrying, I answer all questions asked, and inform before exiting vehicle. No problems, so far and I open carry at 4 o'clock a large handgun on oppositte side from my wallet. (I conceal carry after coat is put on.)

What would they be 'running the serial number' for? Looking against some list of firearms reported as stolen? They certainly can't check that you are the listed owner of said weapon since there is no registration system. If a list of stolen firearms, who maintains that? BCA?

I'm not a LEO, don't even play one on TV, but here's my thought process............

If any "authority" figure or organization wants to confiscate guns, my answer is always NO!! Followed by action.

If I'm stopped at a traffic stop, I hand over the DL and the PTC together. If the LEO asks if I'm carrying, tell him/her "Yes" since it's better for them to find out upfront than down the road where then they would have a reason to suspect you for hiding other things as well.

Best advice is try not to get pulled over. You should know when your headlights are out, driving in the dark behind a car you should able to see if you have one or two healamps on. On the other hand some people drive w/out headlamps on at night :?

And what do you do/would you do if/when they ask you to hand the weapon over for safekeeping during the stop, and so they can run the serial number?

At what point during the stop would the cop discover that you were carrying? If it's concealed, you're not asked to get out of the car, and he didn't ask, how would he know? Of course, if it's going to be discovered because you open carry like XDM45, then of course you should disclose right away...

Let's take the second part first: The law says you MUST disclose if asked. Period. End of story.

As far as saying "NO!" to the cop who wants to hang on to your gun during a stop...You're going to refuse to comply? And that will be followed by WHAT "action," exactly. A three minute staredown? Or you staring at the business end of the cop's pistol? :roll:




Let me know how that works out for you. Have you given ANY thought as to what will happen next after you say the equivalent of "from my cold dead hands." ??
