Permit to purchase

I have applied for a permit to purchase in Jan 2013. The St. Paul police have sent me three letters trying to deny me a permit. I have no criminal reason or mental health issues that can prevent me from having a gun permit. The last letter that was sent gave no reason for being denied. I need help.

I would try with the county. I hate dealing with city municipalities, too much goddam liberal politics in the ranks.

I live in a city and went to the county for mine. When I lived in Rogers I was told I had the option of going to the city or Hennepin county.

Figured it was worth a shot for him.

AND maybe bring up a Permit to carry application, you can then file an appeal if denied and go after your expenses and attorney costs.

Seems odd, everything I can find on applying for a permit to purchase seems pretty clear. If you live withing the city you apply to the Chief of Police and if you live rural then you apply to the County Sheriff. There is an exception that if the municipality does not have a police force, then the application would go to the County Sheriff.

Unfortunately the MN laws between PTP and PTC are different and there is no recourse for denial of PTP. As such the recommendations by the OP is sound (seek lawyer or PTC).

However if you do not wish to spend further monies, then you may be entitled to obtain the denial reason under the "Minnesota Government data practices act". More specifically here:

You are entitled to see information regarding yourself:

"Subd. 3.Access to data by individual. Upon request to a responsible authority or designee, an individual shall be informed whether the individual is the subject of stored data on individuals, and whether it is classified as public, private or confidential. Upon further request, an individual who is the subject of stored private or public data on individuals shall be shown the data without any charge and, if desired, shall be informed of the content and meaning of that data. "

you didn't mess up your address or info that they probably want to match your drivers license? before getting a lawyer or dealing with that background check website thing, have you tried calling?

I thought I remembered seeing it 'officialy' stated last year when I got mine it was shall issue and seven days to wait for an answer the same way it is for a permit to carry. Now there is no official statement made regarding it, and only old info of people on forums (who at least to me seem like they are the ones in the 'know') saying things like seven days and shall issue for purchase.

did something change or am I wrong?

Not entirely true. If wrongfully denied, you can go to district court to get a "Writ of Mandamus" which orders the PD to do their job, or be held in contempt.

Like you pointed out, there is no guarantee of the PD picking up the tab, as there is in out PTC law.

On the cheap:

You can point out to the PD that they are statutory required to give you a reason, and hope they comply. A Data Practices requests would be available to you as you are the subject of the data (MN SS 13.04 as pointed out above).

I have had P to P problems as well.

Got one from the same police chief multiple times. Then he decided he wanted to go above and beyond what the law was and wanted to see my birth certificate, Social Security, and/or passport. Apparently this pasty white middle age guy was possibly an illegal immigrant.

I showed him the law, showed it didn't list the necessity of me to prove my citizenship to him. His response was to neither give nor deny. He simply did nothing.

So I got a CCW (yea yea no need to C while Cing) instead...because the cost of class plus filing fee was less than it would cost to get a lawyer to fight the chief.

Yes, easiest of all would have been allowing him to see documents he legally had no right to demand, but that just stuck in my craw.
