California Transfer Advice

Anybody have insight on the correct procedure to legally transfer a hand gun from a Minnesota resident (me) to a visiting California resident (daughters boyfriend)

Well to transfer a handgun to a CA resident you will need to find an FFL in CA to do the transfer to him. Also you will need to reference the pistol against this Roster of CA Certified for Sale guns. Also no magazines over 10 rounds are allowed with the transfer. My understanding is that acquiring larger magazines out of the Jurisdiction of CA is allowed.

Edit 2: Not sure how out of state transfer falls into the private party exception since it has to transfer through the FFL

If it leaves the state and possession of the original owner - whether a loan, gift or sale it is considered a transfer.

Thanks. The gun, Rock Island 1911 is on the approved list. So now we have to find a CA FFL to handle the transfer and proceed from there.

CA transfers are expensive. Be prepared to spend $50-75
And by law you need to notify the shipper that you're shipping a firearm.
FedEx & UPS will require overnight shipping for a handgun.
Be prepared to spend another $75

As a follow on to Thunderjohn's post- consider having a local FFL (such as Thunderjohn) ;) handle the shipping/ transfer.
It will be quicker, and easier for you, and might even cost less, as an FFL will have less expensive shipping options available to him.
It's possible it could even help in securing a CA FFL, as some will not accept out of state transfer firearms from individuals.

This is exactly why "Transfer" is used, not "sale" or "Gift".

FFL is needed, Beckwith's advice is sound.

This. Since it's a 1911, you don't have to worry about mags over 10 rounds, but FYI mags over 10 rounds can be sold as rebuild kits if they are disassembled until Jan 1st, after that he's SOL due to a new law.

Make 100% sure the EXACT model is on the list or it will not be able to be transferred.

To ship a gun to California(which you will need to do, you can't just hand it to him while he's here and allow him to take it back with him), you can either ship it directly to a FFL(which will be expensive) or have a FFL ship it. If you have a FFL ship it, they need to be registered to ship to California(CFLC) and get a Firearms Shipment Approval number, see: http://oag.ca.gov/firearms/cflcfaqs

Standard rates for using a FFL to ship are going to be in the $20 range(plus shipping of course). On the receiving side, the FFL in California will probably charge $75-125. If you look around you may be able to find as low as $50.

The buyer will also need to get a Handgun Safety Certificate(http://oag.ca.gov/firearms/hscinfo) if they don't have it already, another $25. It's a 30 question multiple choice that is very easy to pass if you have basic knowledge. And th buyer will need to demonstrate they can safely handle the gun(to include loading and unloading).

Oh, and they will have to go to the FFL, complete the paperwork, then wait 10 days and come back to pick it up.

Yeah, buying guns in California is fun....

Oh, almost forgot, make sure a lock is included, otherwise the buyer will need to buy an 'approved' lock, or complete an affidavit that they have a DOJ approved safe to put it in.
