Selling A Assault rifle Advice

Postby LarryP on Thu May 15, 2014 9:30 am

I'm thinking of selling a MAK 90 rifle, drum & clips I bought new back in the early 90's.
I'm not up to date on present laws.
If selling it myself, are there any special actions I need to take, Is it any different than selling a "normal" rifle?
Also thinking of putting it on consignment with a dealer if best
Thanks

Don't sell it to anyone who you know cannot legally own it. Other than that, do whatever you want. There will be lots of folks stopping by shortly to tell you about all kinds of things they think you should do, carry permits, drivers license, bills of sale, etc.

Nothing special to be concerned about. I'd post it on Craigslist.

Feel free to ship it to anyone in the world as "auto parts" via USPS.

If taking advice from people on the Internet worries you perhaps you should have some other requirements.

Make sure to get a retinal scan of the buyer.
Take their fingerprints and send them to the FBI.
You can also get a renal and anal scan along with a DNA sample.

I'd also post it for sale here first.

The level of sarcasm there seems a little out of line.

If the buyer went to a store to buy it they would need a permit to purchase or permit to carry. A face-to-face personal sale though it is not by law required. A lot of people will tell you though that you should ask to see a permit to purchase or permit to carry, do a bill of sale, etc. It's basically all about covering your own #&* in case they use it to commit a crime. This page sums it up pretty well:
http://smartgunlaws.org/private-sales-in-minnesota/

Dealers won't take just anything for consignment usually. Your asking price has to be right and they have to think it is something they can sell.

Another option is take it to auction. Lampi Auctioneers has an auction in June and stuff usually goes for decent prices there. You'll loose a cut similar to a consignment at a shop. I think it's 15% if under $300, 10% for $301-$1000 and 5% for $1000+. Obviously there's no negotiating the selling price though so there's some risk there. They only accept reserve prices on really high value stuff.

This is bad advice. Federal law requires that you disclose that the package contains a firearm.

A lot of smart A$$ comments, I was only wondering if Mn had any special rules for assault rifles. That was my only concern. I'll probably consign it at a gunshop so I won't have to worry about anything.

"Assault-style" rifles in Minnesota generally fall under the same rules as for handguns. For me to buy one, for example, requires that I show a PTC/PTP.

Only if you buy it from a dealer.

Why lose money selling on consignment at a shop? You'll have no trouble finding a buyer here (if your price is in line) and if you want to ask for the buyer to show a DL and permit at the time of sale that is up to you but not at all required. There is nothing difficult, nor is there any legal repercussions that can fall back on you as long as to your knowledge the person is legal to own the firearm. No different than it would be for a single shot 410.
