Carry Permit

Hi. I'm a newbie here. Just wondering if anyone knows what to do if my carry permit doesn't show up within the 30 days. I have already tried calling the sheriffs office, but am unable to reach the person I need to speak with.

Technically, if they don't issue or deny the permit within 30 days, it's considered issued. Good luck with that if you get stopped though...

Some SO's will stretch it out and say its 30 business days, how long has it been? Which County are you dealing with?

A poster above said it is considered issued and, under the law, that is correct. However, I believe you must carry your permit with you, so I would not carry until you have the permit in your possession.
In my county, at the county government center, they have a carry permit desk. I recently needed a replacement permit and they were able to create one on the spot. I am sure you know about the permit desk since you probably needed to appear in person at that desk to apply for your permit. If you show up there with a copy of the receipt they were supposed to give you and a copy of the statute, you might be able to persuade the clerk to create a permit on the spot for you since it is considered issued after 30 days with no denial. Otherwise, if they are stonewalling you for some reason, you might need to request a hearing before a judge.

Which county? During my most recent experience with Dakota County, they mailed it out literally at Day 30...the permit card wasn't in my hot little hand until Day 35.

As others have stated, your Carry permit status isn't a tangible thing...meaning, you don't NEED to have the card to be permitted to carry...but, as still others have said, good luck proving that to a cop on the side of the road.

You need the card if you are carrying. This is the law:

624.714 Subd. 1b.Display of permit; penalty. (a) The holder of a permit to carry must have the permit card and a driver's license, state identification card, or other government-issued photo identification in immediate possession at all times when carrying a pistol and must display the permit card and identification document upon lawful demand by a peace officer, as defined in section 626.84, subdivision 1. A violation of this paragraph is a petty misdemeanor. The fine for a first offense must not exceed $25. Notwithstanding section 609.531, a firearm carried in violation of this paragraph is not subject to forfeiture.

Thanks everyone for your input. I am working with Nicollet county. I wouldnt dare carry without the permit even though I know it is already valid. It's only 2 days late, but I am frustrated since I didn't bother with a purchase permit. So the gun I bought is still sitting at the store I purchased it at.

Odd, Nicollet county usually has a very quick turn around time. I would make a call. My students report good service from Nicollet Cnty.

The person that originally answered the phone had said that the woman that does the permits is just swamped with them. I still hadn't heard back from her. I left a message the other day. I hate to harass them and make it take longer. Lol

I imagine with the election, there may be a perception that people have to get their permit or lose out. I'd say if it's an issue contact one of the fine gun rights groups represented here and request some assistance...........and.........its a good idea to sign up and donate too.

It's one thing feeling like you're "harassing" them for a status update, even 29 days in, but past 30 days, with malice or not, your constitutional rights have been infringed. I'd march right in there, and in the most polite way possible, ask for a status update. And I'd do it without any guilty feelings, at all.

You forgot subpart (b) ;) - thank Joe Olson and David Gross every day for the subtleties of this law.

(b) A citation issued for violating paragraph (a) must be dismissed if the person demonstrates, in court or in the office of the arresting officer, that the person was authorized to carry the pistol at the time of the alleged violation.
