You need the card if you are carrying. This is the law:

(b) A citation issued for violating paragraph (a) must be dismissed if the person demonstrates, in court or in the office of the arresting officer, that the person was authorized to carry the pistol at the time of the alleged violation.


Great point. I did not keep reading after I thought I found my answer. I believe that 1) as long as you are willing to deal with the hassle of going to court; and 2) you are willing to take the risk that a potential denial was not lost in the mail, then carrying without your permit would be lawful.

The permit status database is accessible to dispatchers...all the officer has to do is have them run the query...heck, they probably had it done when you were pulled over based off the registered owner of the vehicle...

Either way, obviously best practices say to carry your permit card. I just enjoy pointing out that the law is crafted in such a way as to protect you if you inadvertently forget your wallet or the permit gets "held up in the mail" (either accidentally or intentionally) by the sheriff's office.

just don't assume that the "held up in the mail" (either accidentally or intentionally) by the sheriff's office permit has been entered into the data base.

Would they keep your firearm until you produced your permit. Also if it has not been entered into the data base I bet you may be arrested and jailed depending where you are stopped. Go ahead be a test case, if you can afford it.

The guy says he can't get through to the proper person. I personally would just go down there. In my experience, in Hastings, the people there are very friendly and helpful. If you go down there, I recommend you leave the firearm in the car, don't bring it up to the counter. :)

Still waiting. BTW- I am a woman. I finally was able to reach the person I needed to speak with at the SO. She said she had been waiting on something from Pennsylvania. She said she would try to get it done tomorrow. I asked if I could pick it up rather than waiting on the snail mail, especially over the weekend. She said it would be ok, but I had to call her first to make sure it is done. Hmmm
I also called the store where I purchased the pistol. The said they are happy to hold onto it until my permit arrives. I added extra Houge grips to it also. It wasn't a cheap gun. Wouldn't it be a trip if they switched it out and sold it?

They have 30 days. Period.

If you'd care to PM me specifics - I'm sure one of our State advocacy groups would love to send the Sheriff a reminder of the law.

Sig Sauer P238 .380. I've been shooting with that same gun but renting it at the range. I love that pistol! I used to shoot with hubby's S&W 9mm M&P, but it was just too much for me. I have Fibro and my hands would swell up for days after. I am much more accurate with the .380 anyways.
