Time to get free legal advice on giving guns to my kid!!

Postby Seismic Sam on Fri Jul 15, 2016 7:02 am

:( :o

I have a variety of guns that I have purchased over the years, and my daughter, age 29, would like to have some.

Specifically, a Colt Woodsman (circa 1956) that my dad bought new when he found out that I loved to shoot, so that additional generation jump may add some additional complexity to the issue.

A Smith Stainless 10 shot .22LR revolver that I bought for my daughter to teach her to shoot 20 or so years ago.

A Marlin SS .22LR stainless bolt action rifle that uses 10 shot mags.

Thank you for any enlightment you can give me on this issue!

Does your daughter live in Minnesota?

Is she a prohibited person?
Nothing to see here. Continue swimming.

You didn't mention where she lives. If she's a MN resident, I believe you can simply give them to her. Crossing state lines muddies the waters a little bit.
According to this site, if you aren't both residents of the same state, it has to go through an FFL (with one exception)...

3. Long Gun Possession
...
c. Gift / Loan - A person of any age may receive a LG as a gift or a loan from a non-licensee who resides in the same State as the recipient.
d. Outside State of Residency - A person may not receive a LG from a non-licensee who resides in another State, except by:
1) Will or intestate succession, § 922 (a)(5)(A) giver, § 922 (a)(3)(A), receiver, or
2) Temporary loan or rental for lawful sporting purposes, § 922 (a)(5)(B), or
3) The non-resident may send or deliver the long gun to a Federal Firearms Licensee (FFL) in the receiver’s State for purchase from the FFL, §922 (a)(2)(A)(unless the recipient State bans that type firearm)

4. Hand Gun Possession
...
d. Gift / Loan- A person 18 years of age or older may receive a HG as a gift or loan from a non-licensee who resides in the same State as the recipient.
e. Outside State of Residency - A person may not receive a HG from a non-licensee who resides in another State, except by:
1) Will or intestate succession, § 922 (a)(5)(A) giver, § 922 (a)(3)(A) receiver, or
2) Temporary loan or rental for lawful sporting purposes, § 922 (a)(5)(B), or
3) The non-resident may send or deliver the HG (see § 1715, HGs non-mailable) to an FFL in the receiver’s State for purchase from the FFL, § 922 (a)(2)(A).(unless the recipient State bans that type hand gun)

Gee, thanks, Doc!! The fact of the matter, however, is that I am WAYYY older, way crazier, and at least as big as any prison bubbas of any [#myskincolormattersmorethanyours/#] memberships, so the bubbas will be crying for their mommas!!

AHHHHHHH!!!! The green bugs are back and crawling all over me!! I need a BIG can of sterno and at least TWO loaves of moldy bread to strain it through!!!

Unless your memory is failing you in your dotage, and you've now forgotten you previously transferred those exact firearms, (the description of which is now posted for posterity), to your daughter when she wad a resident of this state, you should use a FFL in your' daughter's state of current residence. :?

If your daughter lives out of state, there is always the chance that she moves back home for a little while, and that would be the perfect time to give them to her without messing with a FFL transfer. You would want to document everything, of course.

Didn't you give them to her years ago when she was still at home and you've just been storing them for her??

Actually, she STILL lives at home with me in Minnesota, so everything seems OK.

As long as she is here, jest give them to her. Have you considered a cheap gun trust for the feature for the rest, make her the beneficiary incase feature laws make it harder to do so. You can still put on and remove at will incase you sell some or she don't want them.

Sam, does this mean you don't want my GI 50 and Coonan when I drop dead?
