Permit denied, next steps..

Postby Gunnar on Thu Mar 03, 2011 10:31 am

I spoke with Stillwater PD, they were very polite and stated that the permit was denied, and that I should look into hiring a lawyer. I sent an email to Marc Berris. What other steps should I take? Does anyone have any experience with this?

Thanks everyone.

Wait for Marc, do not do anything else until you hear from him........................

Did you get a letter telling you why the permit was denied? Can you share the reason it was denied? Marc Berris is a good attorney, but like all attorneys they cost money...

This is very sound advice.

I would recommending against sharing any information with anyone other than your lawyer. Including having a discussion here about the denial.

Well he already admitted a few things publicly about his past. I was curious as to if they were denying it related to those charges or something different.... Most importantly I wanted to know if he received a letter like he was suppose to:

Subd. 5.Granting of permits. The chief of police or sheriff shall issue a transferee permit or deny the application within seven days of application for the permit. The chief of police or sheriff shall provide an applicant with written notification of a denial and the specific reason for the denial. The permits and their renewal shall be granted free of charge.

I highly doubt telling us if he got a letter, or the stated reason for the denial on that letter, will make any difference from his lawyers perspective or that of the legal system. I wasn't looking for him to try and explain his past in detail or talk about any convictions against him.

Highly doubt And know are two different things. I doubt it would make a difference too, but much like you I'm not a lawyer, don't pretend to be one, and didn't stay at a Holiday Inn Express last night and don't KNOW. Us being wrong about the impact on the OP from information shared publicly regarding his case might make things more difficult for him.

Might not too, but if it were me, I would rather get that information from my lawyer than some Joe shmoe behind a keyboard that has nothing to lose from me not getting my purchase permit.

Just sayin'

I think we all have something to loose if someones rights are being denied unjustly. I completely agree that he should do what his lawyer tells him to if he has obtained council. If he's unable to obtain/afford council he could also try and appeal the denial himself:

Unfortunately unlike a permit to carry, if your permit to purchase is denied the cost of the hearing is footed by the applicant.

You should get that.

Please don't do so without advice of council.

I'd recommend that you post *nothing* else in this thread (or elsewhere) and talk with competent counsel.

Good luck!

As others have said. Get letter from PD. Contact attorney and post nothing else.

Was it actually the Stillwater Police Department, or the Washington County Sheriff? Tim Hutton is the County Sheriff, and he is a straight shooter all the way. Tim was the one who sent out letters to all permit holders in Washington County who had permits signed by Sheriff Jim (Dickhead) Frank with the latin phrase "sub recoso", which means under REFUSAL (not protest!) below his signature. Sheriff Hutton plainly said that he did not feel that official County documents should have something like that on them, and if you signed the form enclosed and returned it you would get a new permit. I sent in the form and had a new permit with his signature on it in THREE days. I have no idea what the Stillwater PD is like, but if Tim Hutton denied the permit, then in my own mind I'm certain he had a damn good reason.

And yes, you need to keep your mouth shut regardless of the situation until you talk to Marc Berris, and he will probably tell you the same thing that George Kappas of the Gopher Bar would tell you, which is to STFU...

I am actually upset about that. The fact this guy is going through the trouble of trying to legally purchase a firearm should be commended. Our society generally forces the law abiding to follow increasingly complex regulations and restrictions. It's also fairly easy to get a felony in the wrong circumstances, and disenfranchisement and deprivation of civil rights once your term has been served generally haunts a person their entire life.
