Legal carry without a permit in MN

I just got back from lunch and heard the owner of a restaraunt claim, "In Minnesota if your a business owner you can carry a pistol legally back and forth to your business"

That used to be the law, not sure if it still is, but it was legal to carry from to work and at your place of business without a permit. I doubt it has been supplanted but it might have been with the carry law

Subd. 9.Carrying pistols about one's premises or for purposes of repair, target practice. A permit to carry is not required of a person:

(3) to carry a pistol between the person's dwelling house and place of business;

The only part that seems a little confusing is the "place of business". Does that mean you have to be the business owner? Otherwise if you own the business it should be perfectly legal. Your layer can explain that when he comes and gets you outa jail.

The way I read it, It means for "Repair or target practice" Not for self defense carry. Who the hell wrote that trash anyway?

Dean did a half-assed quote job. The bold section below is the subdivision's title.

Subd. 9. Carrying pistols about one's premises or for purposes of repair, target practice. A permit to carry is not required of a person:

(1) to keep or carry about the person's place of business, dwelling house, premises or on land possessed by the person a pistol;

(2) to carry a pistol from a place of purchase to the person's dwelling house or place of business, or from the person's dwelling house or place of business to or from a place where repairing is done, to have the pistol repaired;

(3) to carry a pistol between the person's dwelling house and place of business;

(4) to carry a pistol in the woods or fields or upon the waters of this state for the purpose of hunting or of target shooting in a safe area; or

(5) to transport a pistol in a motor vehicle, snowmobile or boat if the pistol is unloaded, contained in a closed and fastened case, gunbox, or securely tied package.


I think it's pretty clear. But again, good luck with that on the side of the road. You might beat the rap, but you won't beat the ride.

But seriously, target practice is just one of the reasons. The subdivision says
"Carrying pistols about one's premises or for purposes of repair, target practice."


A person's business is their premises. It further states that a person without a permit may
"carry a pistol between the person's dwelling house and place of business;"


Does that mean you must own the business? The general consensus among instructors is, yes, it means your business that you own. (But then again, they are selling classes :P )

The other limitations to this come from case law. It must be direct (Don't stop at the bar) It must be a fixed location(Not a courier or taxi driver) and it must be in reasonable proximity (Not a cross country airline flight IIRC)

So much simpler to get the permit. The Lawyer's first 2 hours on your case will be more than the class + Permit.

Case Law is "State of MN v Poupard", I'll try and find the document when I get home.

I read the statute from the site, It still makes me wonder who writes this stuff? Lawyers and their job security policy I guess.
