Unloaded and cased

Postby brosnt1 on Mon Jun 18, 2012 10:30 am

I have a question concerning transporting a firearm. I am always nervious about wear I keep the clips and if they should be emptied or stowed in a different location from the cased gun. What is concidered unloaded. Lately I have been emptying the clips , and keeping the empty clips with the firearm. Can you keep the clips loaded with ammo in the case if they are not in the gun?
Thanks in advance

From the MN DNR Hunting Regulations Book

Firearms Transportation
Unless transporting under the exceptions listed below, a person may
not transport a firearm, including a handgun, in or on a motor vehicle
unless the firearm
is:
• unloaded* and in a case made expressly for that purpose;
• unloaded* and in the closed trunk of a motor vehicle; or
• carried under a valid permit to carry a pistol or handgun.
Under the following circumstances, a person may transport
unloaded, uncased firearms (excluding pistols) in a motor vehicle,
including ATVs:
• while at a shooting range with permission
• while lawfully hunting on private or public land or while travelling
to or from a site the person intends to hunt or has lawfully hunted
that day.
Firearms must be transported unloaded and cased:
• within Anoka, Hennepin, or Ramsey counties.
• within the boundaries of a home rule, charter, or statutory city with
a population of 2,500 or more.
• on school grounds
• as otherwise restricted in game refuges, shining or night vision laws.
Transportation of Bows
No person may transport an archery bow or crossbow in a
motor vehicle unless the bow is not armed with a bolt or arrow

* An “unloaded” firearm is defined as a firearm without ammunition
in the barrels and
magazine, if the magazine is in the firearm. A muzzle-loading firearm with a flintlock
ignition is unloaded if it does not have priming powder
in a pan. A muzzle-loading firearm
with percussion ignition is unloaded
if it does not have a percussion cap on a nipple.

Welcome to the forum.

First off, clips =/= magazines. Nitpicky I know, but correct none the less.

Second, do you have your permit to carry? If so, it doesn't matter how you transport it.

Next, if you don't have your permit to carry, now it the time to get it.

Lastly, don't take the word of strangers from the internet regarding matters of law. Find the regulations on the MN DNR website, or contact your local police department. It would be a bad for you if you followed the advice of folks here, and they were wrong.

That said, My recommendation would be to transport in a proper case, magazines unloaded. Wouldn't want the LEO that pulls you over have a different definition of "Unloaded" than yours, right or wrong.
If you're reading this, there are better than even odds you are a d-bag.

An “unloaded” firearm is defined as a firearm without ammunition
in the barrels and
magazine, if the magazine is in the firearm.

Thanks for the welcome. I usually dont take advice from strangers on the internet when I can find it from the proper source. I am about to apply for my permit to carry this friday, if I can get down to hennepin co. by 3:30. There will be times when I don't want to carry, so what I read here is: If I have 2 clips filled with ammo, and in the case with the unloaded gun, this is considered unloaded? I'm looking for just you opinion
Thanks

My personal opinion......

If the firearm is cleared (nothing in the chamber) in a case designed for a firearm, no magazine in the well, the magazines are loaded and in a seperate compartment, and the bundle is not within arms reach, I believe it falls under the definition of an unloaded firearm in Minnesota.

The question remains.... Will the cop who is having a bad day when he/she pulls you over share that definition?

Good on you for getting your carry permit. That will make all of this a moot point.

There's many reasons for getting a PTC, but this is one of them. It's a minor inconvenience to keep ammo, mags, weapons separate, but a huge inconvenience if you break the law and get caught doing so. It's one of the reasons why I want my own PTC.

Definition of unloaded: MN 97A.015

Transport requirements: MN 97B.045

The magazine need not be in a separate case or container even if it contains ammunition.
