Postby silverado chevy on Wed Mar 06, 2013 4:27 pm

i was in the store at about 3pm and they had 2 ARs in the case behind the counter one was a bushmaster with a red dot package looked like a cheap barrel(skinny, not an M4) for just under $700 and another not sure what the brand was for just under $1000 ammo shelves were still empty. also worth mentioning Bills in circle pines had a few ARs on monday and a DPSM 308 for $1100 good luck

Lakeville had 3 bushmasters in, but they were gone in 20 min yesterday. These were the $994 M4 clones NIB. Still have .223 uppers.

I'm honestly wondering what the ATF thinks of things like this. I may have to give them a call and see what they think or if they care of the hundreds of guys buying ars just to flip them without an ffl.

You don't need an FFL to flip a gun. You only need one if you're in the business of flipping guns.

Yep. If I was buying guns with the sole purpose of flipping them (more than just once or twice in a small time frame), I'd have an FFL ship or do the transfer for me....to be on the safe side. It's a grey area when they say "in the business". The only prosecutions I've heard of are folks doing it on a large scale, like buying and selling hundreds of guns without an FFL. To show I was "in the business", I needed to have an actual business set up.

If you're directly buying a gun for another person, don't even do it once. When you're buying a gun with the sole intent of selling immediately (private sale, no 4473 or FFL involved), I feel like that could easily be viewed as a straw sale. However, if you're selling these out of state and shipping to an FFL, I don't see an issue. Similarly, if you're buying guns with the sole intent to sell in state, using an FFL might be a good idea. IANAL, and no expert on firearm laws....I just do what the ATF has instructed me to do, and if I am unsure of something I call my field agent.
