Getting a C&R FFL license

So, I'd like to get a C&R license, and found a very nice guide on garandgear.com that goes step by step. If anybody else is looking into getting one, check it out.

I have a question though, in Section 14 it requests your Chief LEO information. What are they requesting? Your local city cop shop, or your county sheriff? Little background, I live in a major suburb and have a PTC from the county.

Which one? My gut instinct says city, but it isn't clear on what they mean by "Chief LEO"

Thoughts, real life examples?

If the city you live in has a police dept you use the Police Chief not the sheriff

Its just a notification on a C&R -- means you send a letter to the head of your local Law Enforcement (Police in a city with one, Sheriff if not) notifying them of your intent to obtain a C&R FFL. They don't need to sign anything or "approve it" - its just a notification.

Does one need to have an established and active business (with all that entails) to possess a C & R FFL?

25 years ago it appeared next to impossible to get a an 01FFL in St Paul, due to zoning and municipal regs.

An 03FFL C&R is only for "Curios & Relics" collecting and not for business purposes. As such, you can be located anywhere, and are not subject to the security and other requirements of an 01FFL. You DO need to keep a bound book and scrupulous records of your acquisitions and dispositions though.

Is that of all acquisitions including "modern" guns or just those purchased under the C&R license? Have thought of getting a C&R myself as the cost of transfer fees in addition to shipping and insurance, for some of the older guns I'm interested in up the price beyond what I want to pay. If I have to keep records on "modern" guns too might be more of a hassle than I wish.

No, the C&R bound book requirements only apply to C&R firearms. There is an ATF FAQ somewhere though that says you have to log all C&R acquisitions and dispositions whether you used your FFL or not.

The C&R is a great deal. Pretty much one purchase will cover the cost of the license and with many vendors, it gets you dealer pricing.

Logging into and out of the bound book is only for items you've acquired via your C&R license. If you opt not to renew at the end of the 3 yr period, you don't have to send in your records either.

Thanks for the replies. I looked into applying for a C&R last year but did not recall reading that piece. I'll have to stop by the BATFE booth at the Pine Co go-tech gun show again. If they are there again.

Its not a requirement to log ALL C&R acquisitions and dispositions -- only those that you run through your FFL. I acquired a Garand via the CMP while I held my 03FFL -- even though its a Curio and Relic -- because I didn't use my 03FFL to acquire it via Interstate Transfer (CMP gets a congressional pass from the Interstate transfer rules), it didn't require logging into my bound book.

I acquired a 1903A3 from a seller in Arizona. He shipped it to me via my 03FFL (Interstate Transfer)....that goes into the bound book. I go to a WI gun show and find an M1 Carbine I like -- I use my 03FFL to transfer it back to myself in Minnesota (Interstate Transfer)....that goes into the bound book.

I buy a Mosin Nagant off someone locally here in MN -- that does NOT go into my bound book (Intrastate Transfer)

It helps to establish a "Personal Collection" list that is separate from your "Bound Book" list. Helps to keep things straight.

Where people get into trouble with a C&R is by buying a whole bunch of items from a distributor -- like a crate of mosins from Classic (or something like that) -- and then reselling for a profit. Other area is by not being careful with your records. I typically try to hold onto any C&R items transferred with my 03FFL for at least a year before transferring either to myself, or anyone else (pretty rare).

Trading one in and out is just fine, if its in furtherance of your "Personal Collection"....regularly buying just to resell? Gets you in trouble.

Nice thing is -- if you get picked for an audit -- you can usually just bring your bound book out to the ATF office. They don't usually do a "touch" audit at your home.

Photogpat: That's the way I understand the "Bound Book" for a 03 C&R FFL. You need to record ONLY those bought (and sold) using your 03 FFL.

Your personal old guns do not need to be in the book.
