If you need to brandish/flash/whatever you call it, a sidearm to win a stinkeye vs finger debate in traffic... You are a sad little person that is coming up short in the wiener department. You will be somebody's sally in federal penitentiary and rightly so.

Neither a sheriff, police chief, any employee of a sheriff or police chief involved in the permit issuing process, nor any certified instructor is liable for damages resulting or arising from acts with a firearm committed by a permit holder, unless the person had actual knowledge at the time the permit was issued or the instruction was given that the applicant was prohibited by law from possessing a firearm.

My take on brandishing a weapon would be to REMOVE the fire arm from the pouch, bag, or holster for other than cleaning, training, and saving your life. If your jacket blows open and your weapon is in its holstered position then I do not consider that brandishing. Of course I am sure there is some perception on that subject as someone could say you did brandish and the thing never left the holster. That would be information to tell the official called to the scene if the issue went that far.

I'm curious if there's more to this story than meets the eye. I'm wondering if maybe there was more ragin' going on than just flashing lights and honking. Maybe the carrier made the admittedly unwise choice to brandish in an attempt to deter what he perceived as an aggressor and wound up having the other guy call the cops first after being startled back to reality. Just speculating.
