This is crazy...
According to Minneapolis Police, a 2-year-old boy was shot by a boy who is under the age of 5.

3 blocks from HCMC - not a very good part of town and gun not likely "stored" in the neighborhood.

this happened to the family of a woman i work with. very, very sad story. you don't know the details and i'm not about to post any of anyone elses personal business on an open forum.

i don't know the whole story either. it happened to a good family doing what they could in a bad part of town. that's all i'm comfortable saying. it's a **** tragedy.

so before all the internet arm chair operators start assuming a whole bunch of bull **** and monday morning quarterbacking the situation, remember that someones child is dead. think for a minute about how much that sucks.

what can you take away from this today? instead of getting all philosophical on a **** internet chat board, go hug your kids tonight and double check all your gear.

My thoughts are with this family -- I can't even imagine what they must be going through right now.

The details of this shooting will probably be public record before the month is out. It's against the law to allow children under 18 to have access to loaded firearms in Minnesota: 609.666 NEGLIGENT STORAGE OF FIREARMS.

It's a tragedy when anyone who's innocent dies. Especially if it was the result of a grown adults negligence. The county attorney is reviewing the case.

I've got nothing intelligent to add to this incident...but about 18 months ago we witnessed this.

Maddy Montane: Spring of 2011 a girl who got a 22 bullet in her head by negligent handling of firearm by her father.

It's entirely possible that 'compassion' for the father prevented him from receiving any disciplinary (educational) consequences for his negligence....

Again, without any comment on this incident...an opportunity was lost...where the father was not 'disciplined' (educated) because of an excess of 'compassion' for the family.

That was someone else's call (the dad may have been on Suicide Watch for all I know)....I'm just an internet Commando-Operator. I think if I had put a bullet in my 11 year old daughter's head ....one of my first thoughts may have been 'I don't deserve to live' Armchair quarterbacking over.

BRAHAM, Minn. -- An 11-year-old girl from east-central Minnesota is reported in critical condition after being accidently shot in the head by her father Thursday.

Pine County Sheriff Robin Cole says Maddy Montanye's father was doing target practice with a .22-caliber pistol outside his home near Braham when the gun jammed.

Cole says he brought the gun inside the house and was trying to fix it when it went off Thursday evening shooting Maddy Montanye in the head from across the room. The father had been in the living room while Maddy was seated at the kitchen table.

The sheriff says other family members were present.

Maddy was conscious when sheriff's deputies arrived. She was taken by air to Hennepin County Medical where she remains critical as of Friday morning.

If you're going to reference the statute, especially one so short, you may as well get it right:

609.666 NEGLIGENT STORAGE OF FIREARMS.
Subdivision 1.Definitions.

For purposes of this section, the following words have the meanings given.

(a) "Firearm" means a device designed to be used as a weapon, from which is expelled a projectile by the force of any explosion or force of combustion.

(b) "Child" means a person under the age of 18 years.

(c) "Loaded" means the firearm has ammunition in the chamber or magazine, if the magazine is in the firearm, unless the firearm is incapable of being fired by a child who is likely to gain access to the firearm.

Subd. 2.Access to firearms.

A person is guilty of a gross misdemeanor who negligently stores or leaves a loaded firearm in a location where the person knows, or reasonably should know, that a child is likely to gain access, unless reasonable action is taken to secure the firearm against access by the child.

Subd. 3.Limitations.

Subdivision 2 does not apply to a child's access to firearms that was obtained as a result of an unlawful entry.


The firearm has got to be loaded for it to be negligence - though if the kid has easy access to both an unloaded firearm and the ammo for it, a talented prosecutor might be able to convince a jury that was enought...

There are other laws on endangerment of a child if you're going to nitpick and be silly.

No one's being silly, but when quoting the criminal law, it's important to be precise. Your description above of MN 609.666 was inaccurate.

Sad story....can't imagine it if that was my son. I'm personally in the process of altering my lifestyle for the sake of my 10 month old boy. He's nearly walking now so the days of leaving a loaded gun on the the nightstand have passed. Now on to the challenge of safety vs. security.
