The media has said many times he could legally own a firearm- no felony/ mental illness issues. There's an assumption that the gun was his.
That a person might have a permit to carry is not information available to the public. if the police release(d) that information, they are in violation of the law.

According to Heather he had a permit to carry. Of course we all know exactly how reliable information from her is.

I am with Ed. You guys that think this defense is your best bet in court: "Uh, I was not in control of myself or my emotions at the time, and I killed the guy accidentally..." by all means that is up to you. Somehow I see a jury hanging you out to dry with your argument of negligence and incompetence...

This is why you pay someone to defend you.

I was kidding with my answer "correct!".

Of course in all seriousness, yes, you hire the best attorney you can afford because we have an American Legal System, not an American Justice System. What is Legal isn't always Just; and what is Just, isn't always Legal. If you have more money than the next guy and you can out lawyer him or her, chances are pretty good in your favor. There's other factors that come into play too of course, such as fame. If your average person even did one thing Lindsay Lohen did, we'd get the book tossed at us. Fame + Fortune = In Your Favor.

I know there's the age old debate about talking to the Police, giving them some information, etc; but just like people talk about 2A with "shall not be infringed" with that being non-negotiable; so too should they realize that "anything you say CAN AND WILL BE USED AGAINST YOU" is equally as non-negotiable. There's no "May" there. Say nothing and get a lawyer because anything you say or do will only hurt you.
