Minnesota cannabis users not allowed gun ownership federally

Until recreational cannabis is federally legalized, marijuana users cannot legally own or use guns. Minnesota House Representative Marion O’Neill recently pointed out some underlying challenges with the new Minnesota marijuana bill.

“There are cases going through the federal courts right now about whether or not it is unconstitutional, to remove someone’s second amendment rights, because they’ve been found in possession of marijuana” said O’Neill.

The bureau of alcohol, tobacco, firearms and explosives clarifies that regardless of the recent Minnesota law, someone who is currently using marijuana is still federally defined as an “unlawful user” of a controlled substance.

“If you are found in possession of marijuana, you absolutely should lose your second amendment rights. That is what Biden’s administration is saying right now” said O’Neill.

I am not a lawyer, and never pretend to be one, but can someone explain how states can pass laws that are clearly contradictory to federal law?

They didn't.

Federal law prohibits cannabis possession, use, growing, etc.

State law did too - that's now been repealed.

There's not a federal law that says states can't regulate MJ. States do, MN decided to deregulate - that has zero impact on federal law.

So if a guy has 2 oz on him, Isn’t high, but gets pulled over carrying; is he then arrested?

Weed is legal in MN. Carrying with a permit is legal. It’s a state officer. Hmmm.

Other than trafficking or possibly large growing operations, aren't the feds 100% dependent on state and local law enforcement to actually catch marijuana users and forward the cases to federal jurisdiction? I can't imagine the FBI or DEA having the resources to police simple use around the country.

No, we are talking law abiding citizens, totally different. With a law abiding citizen, especially one who is maybe right leaning you absolutely must fine something they are doing wrong. That is the only way you can strip them of their rights so you can stay in power. Illegal aliens on the other hand can likely be converted to vote for you, and if not you will just use their vote for them anyway so either way, issue solved. It is really quite simple.

They usually aren't interested in simple use - DEA usually works on the distribution chain, but not always.

Do federal agents have the authority to publicly stop and detain people on probable cause? If that guy in the lane next to you at the stop light is a fed, could he pull you over if he sees you smoking a joint?

He could attempt to stop you and call the local jurisdiction for the stop. It would probably be the same as displaying an open container of alcohol.
