RICHFIELD, Minn. (FOX 9) - A Richfield man faces a murder charge after police say he fired shots at a group of thieves that had apparently stolen items from his van. A woman was struck by the gunfire and later died at a hospital, the criminal complaint states.

This story has made the rounds in local media.
In every case I've seen mention of the '...woman struck by the gunfire and later died at a hospital...', no one has clarified whether this woman had a role in the theft ring, or if she was a completely uninvolved victim.
...not that those details would likely be decisive in the fate of the alleged shooter, but it is a detail made conspicuous by its absence.

Shooting at a fleeing vehicle might, I suppose, be justified in some unusual circumstance, but I can't for the life of me visualize what it might be.

The only situation that has occurred to me involves a threat to one's survival due to vehicle loss;

..a remote, isolated location, in the winter; your food, shelter, and perhaps some rare, vital meds... all in your vehicle, which someone is attempting to steal...
...perhaps analogous to being thrown overboard from your boat on the high seas.

The question might be if such a scenario rises to an immediate threat... but it seems reasonable to assume it's a certain threat

But this incident does not appear to be anything like that.

While theft ought to justify opening fire, the letter of the law is that it doesn't. That said, don't hesitate to interrupt thieves and then use appropriate force in defense of self and others as circumstances may require.

However 1 or more on the jury may question why you put yourself in the position to have to defend yourself instead of waiting for law enforcement..........just saying........ :?

Michael Brasel, 44, a much loved youth hockey coach, was fatally shot multiple times at around 7.30am on Saturday (May 6) in front of his home in St. Paul, Minnesota.
Emergency services rushed to the scene but Michael couldn't be saved and he was pronounced dead at hospital.
According to his wife he was killed while confronting someone trying to break into her car.
