MN law banning binary triggers to take effect

Postby Zarthan on Tue Dec 31, 2024 5:03 pm

They take from us one bite at a time.
I dont have one and dont care to but really dont like how our "Leaders" work us out of our rights by slipping it an Omnibus bill.

MN law banning binary triggers to take effect Jan 1.

New binary trigger law
The background: The law was written and passed months after a man shot and killed two police officers and a firefighter-paramedic in Burnsville in February.
The shooter used a binary trigger, investigators said.
The law makes owning or possessing a binary trigger a felony, with a punishment of up to 20 years in prison or a fine of up to $35,000, or both.

MNGOC
Minnesota passed an absolute ban on “binary triggers” during the 2024 legislative session as a part of a 1400+ page omnibus bill, House File 5247. This was the Tax Omnibus bill, which was amended to include hundreds of provisions, including a binary trigger ban.

QUESTON : If a Minnesota resident owns a binary trigger but physically moves it out of state to other property he owns, is that person still guilty under the law of Minnesota ? (Not Me.)

I also has a "Straw Purchase" law as well.
Nothing like adding a new law on top of an existing law that is not well enforced

Now that the law is in-place, we wait for them to arrest some unlucky citizen and the court case to repeal it can get started.
Anybody volunteer to be the test case? ;)

Would anyone bother with binary triggers or bump stocks or trigger cranks if the Hayes Amendment were to be repealed and we could just buy full-auto firearms; even with all the NFA requirements? THAT I would be the test case for.

Test cases are for other people.

We don't need to wait for someone to get charged to take legal action (hint hint).

Watch for news.

If the law is repealed why would you need to be a test case?

I meant a test case for invalidating the Hayes Hughes Amendment (how did I get that wrong?).

Yes, we keep the case page updated at https://gunowners.mn/worth. We are waiting out an appeal permit, details, the reasons, and the new deadline are posted there.

That would be a multi-million endeavor - and we are a long way away in terms of underlying precedents that should be in place before this is attempted.

(also, this can be challenged without someone getting arrested)

Thanks for your reply. I looked for updates on the site under "New" and saw the July information. Your link is under the "Programs" header and gives the current status. Thanks for all the work.

Per the link: Ellison has until January 17, 2025 to file an appeal to the Supreme Court. If filed, that may still trigger a delay.
