FL: Jogger won't be charged

Fla. jogger won't be charged for shooting teen

TAMPA, Fla. – A pistol-packing jogger in Florida won't be charged for shooting and killing a teenager who attacked him during a midnight run.

Prosecutors said Tuesday they are convinced Thomas Baker acted in self defense when he fired eight shots at 18-year-old Carlos Mustelier near Tampa in November .

Prosecutors say Florida's "stand-your-ground" law was a factor in their decision. The law, passed in 2005, gives people the right to use deadly force as long as they "reasonably believe" it is necessary to stop another person from hurting them.

Really makes me wonder how the same situation would play out here in Minnesota. Imagine a jogger on Lake Phalen getting assaulted in the same manner, then firing his/her weapon in response and killing the assailant.

I moved here from Texas and don't understand the Minnesota duty to retreat.
How many steps back do we have to take before deciding he is coming after us?

You'll have to ask a jury of your peers.

If a jury decides that a reasonable man in your situation could have run away instead of acting like and interweb ninja, you go to jail.

It's actually pretty simple.....
