While it’s not illegal to sell an individual firearm, it is against the law to “engage in the business” of dealing guns without a federal firearms license.


As Gallagher used to say about watermelons and IRS deductions "We'll... What is the limit?!"

This is about as thin to me as charging FPS Russia with illegally using explosives for commercial purposes without a license.

He had 60 long guns and was turned in by fleet farm for buying so many so quickly.

If he bought and sold the rifles in rapid succession, he was a profiteer and I hope he gets prison time. If he had a collection of 60 guns he occasionally sold, I hope he gets off.

Somehow I suspect it is the former.

Think we could get them to do the same with the ammo resellers on armslist?

Lets see, he sold 25 and they stole 60 without charges, who is the bad guy here ??
If charges are never filed, I wonder if he will ever see his 60 stolen firearms, or more again, bet we will never know.

You all who believe he was unjustly targeted should boycott fleet farm for turning him in.

And here I thought they were doing the right thing, preventing straw purchases and preserving their inventory for legitimate buyers at normal prices. Silly me.

I haven't seen anything about straw purchases, maybe every one had a p2c or p2p, who knows.
Even though I have a FFL, I still support the right of individuals to buy and sell firearms freely. I know of
a some who do more than this at auctions, well, before the gold rush.

I am pretty sure filling out the 4473 at fleet farm and saying you are the ultimate purchaser of the firearm when you intend to sell it is a straw purchase and you get to spend some time in club fed. Correct me if I am wrong. You are the FFL.

This part bothers me.

The man has not been charged. But in documents filed Wednesday, federal prosecutors are seeking the forfeiture of 60 assault rifles that were seized from his residences in October.


So he's guilty enough to take his guns but not guilty enough to charge with a crime?

Technically, if they were transferred out through an FFL, would that cover him? Or is he in trouble no matter what for profiting off of guns?

I agree he should have an FFL to sell guns as a means of regular income. If you don't wanna wade in the beat up gun market competing against online sellers, etc. when things are normal, you can't expect to just jump in the business when the market heats up.
