DOJ, Second Amendment Foundation Reach Settlement In Defense Distributed Lawsuit
he Department of Justice and Second Amendment Foundation have reached a settlement in SAF’s lawsuit on behalf of Cody Wilson and Defense Distributed over free speech issues related to 3-D files and other information that may be used to manufacture lawful firearms.

SAF and Defense Distributed had filed suit against the State Department under the Obama administration, challenging a May 2013 attempt to control public speech as an export under the International Traffic in Arms Regulations (ITAR), a Cold War-era law intended to control exports of military articles.

Under terms of the settlement, the government has agreed to waive its prior restraint against the plaintiffs, allowing them to freely publish the 3-D files and other information at issue. The government has also agreed to pay a significant portion of the plaintiffs’ attorney’s fees, and to return $10,000 in State Department registration dues paid by Defense Distributed as a result of the prior restraint.

Significantly, the government expressly acknowledges that non-automatic firearms up to .50-caliber – including modern semi-auto sporting rifles such as the popular AR-15 and similar firearms – are not inherently military.

Twenty states announced Monday that they plan to ask a federal judge in Seattle to immediately issue a temporary restraining order against Defense Distributed, a Texas-based group that has already begun making 3D-printer gun files available on its DEFCAD website after a recent legal settlement with the US State Department.
"After almost 18 months I was skeptical that there was anything else that this administration would do that would truly shock me, but they have," Washington Attorney General Bob Ferguson told reporters assembled in Olympia and by phone. "Frankly, it is terrifying... We think that it is important to put a stop to this right away and make it as difficult as humanly possible to access this information."

That said, the filing reads a lot like a press release:

In June 2018, however, the Government completely reversed its position on the dissemination of the CAD files—not publicly or in accordance with a valid administrative process, but by entering an under-the-radar settlement with a private company known as Defense Distributed (DD). Defense Distributed v. U.S. Dept. of State, 15-CV-372 RP (W.D. Texas).


I wasn't aware that "under-the-radar" was a legal term.

Although the Government’s deregulation of the CAD files in question is nominally “temporary,” it permits Defense Distributed’s founder, self-described “cryptoanarchist” Cody Wilson—and anyone else—to immediately disseminate the files by making them available for download via the internet.


But he's a “cryptoanarchist”. so I suppose anything goes...

I don't see how they can stop him. The plans are already all over the web. If he lost in court he could change to a server service in someplace like Russia and it would be untouchable.

For such a stable genius, he does not get its about access to information, nothing is being sold. I think he doesn't get the rule that once you post/upload something there will aways be a copy someplace, perhaps he is to busy with rule 34 and 35?
