I know the media is out to twist everything they can so I figure they take stuff out of context. If I was not so media savy, I would read this and think that a big time carry expert thinks the permit holder has at least a couple issues with claiming self-defense and would never encourage anyone to act like the permit holder did.

Erik Pakieser, a military veteran who has trained police and civilians in the use of firearms and teaches Minnesota gun-permit classes, said state law and the courts generally look at four elements to determine whether a case is self-defense:
-- Whether the person was a "reluctant participant" and took steps to avoid the conflict.

-- Whether the person had a reasonable fear of immediate death or bodily harm.

-- Whether the person was faced with deadly force.

-- Whether retreat was impractical.

"The two issues I see are reluctant participation and retreat. If he chased the guy, he didn't retreat," said Pakieser, who has taught courses for the American Association of Certified Firearms Instructors.


Pakieser, who teaches up to 10 classes a year for people seeking a gun permit, said he cautions his students to weigh a variety of risks before deciding whether the use of their weapon is justified.

"I would never encourage one of my students to get themselves involved in another person's fight," he said. "Even if they're coming to the defense of an innocent person, I always tell my students that the actions they are about to take are going to have significant consequences. They could get shot or killed, there could be potential criminal liability, potential civil liability. You should weigh those consequences against not acting.

"There's certainly nothing in the law that says you can't whip out a phone and call 911," he said.

"This guy chose a different course of action," Pakieser said of the man in Thursday's shooting. "It's an interesting case, and it'll be interesting to see how it turns out. Myself and a lot of other people are watching this."

I commented on that article on the PioneerPress website. Some of my quotes were incomplete and I think they were used in a misleading way.

I think this quote was published out of context. I went on to say that the court could find the shooter's actions justified because he was attempting a citizen's arrest. I feel this case's outcome will be interesting because it may affect how the necessity of retreat is interpreted.

This assumes the shooter will be charged; if he's cleared outright, then there won't be a test case. That's the outcome I would prefer.

Live and learn, I've done a lot of media before and never gotten misrepresented like that.

Information given to the media has to be given out in short, to the point, sentences. If you are prone to using compound sentences you will find yourself in trouble quickly.

If you were to make a statement such as: "My mother was a saint, she went to church every day of her life, and I would be upset if anyone said my mother was a whore." the only thing that will hit the newspaper is: Mr. XXX said " … my mother was a whore."

Having owned a newspaper in the distant past, and being an editor of another newspaper, gives me the standing to speak with some authority on this. Reporters seek out quotes for two reasons: Color comments and to support their forgone conclusions. They will edit and twist quotes to their own end. The person being quoted is left with a task similar to the guy that sweeps up after the elephants and horses in a parade.

I see they're quoting the Good Samaritan law (as if that was in play here) and the AAFCI use of force info from their website on the "Memorial Page" now.

What a bunch of low life, bottom feeding slime on that face book page!

The man is a convicted felon, carrying a gun, that is illegal for him to have, and committing another
felony with the gun! And they think he was an angel!???? If this goes to trial, we need to find a way to
support the guy!
