Any word on a toxicology report for the dead burglars? It would seem to me they might be on drugs if the shootings really did go down as described. Why would the 2nd person go down the stairs after the first shots? And then taunt the shooter? Lots of fail in this story on both sides. Pretty funny the mini-14 supposedly jammed. Reliability is the one thing usually touted by thier supporters over AR-15's.

I wont sit here and argue about people or a situation I know nothing about, but one thing is for sure: play stupid games, win stupid prizes. (Goes for both parties)

Remember, you're only reading a written synopsis of the defendant's statement to police.

How do you know she actually laughed? Sheet may have between crying...she may have made NO sounds, and the defendant may have hallucinated her response.

Would it matter?
Then we can blame the "drugs" for breaking into the house?
The anti gun crowd uses a very similar backwards logic.

Exactly right, I have a very hard time believing she laughed, especially after her companion was shot to death. 3 people were there, 2 people are dead, and the guy who's left (if the information about his statement is correct) is an absolute psychopath. Everything is suspect here, up to whether or not the two kids broke into his house in the first place.

I feel that the shooter, is going away for a long time! He is either Nuckin Futs, and will be put in a state hospital, or he will spend the rest of his life in jail.

Not right in the head for sure. Yet another lesson for "don't talk to the police." Look at the comments they cherrypicked out from his testimony:

"I want him dead," the complaint quoted Smith telling an investigator.
"...acknowledged firing "more shots than I needed to" and appeared to take pride in "a good clean finishing shot" for one teen, according to investigators
"If you're trying to shoot somebody and they laugh at you, you go again," Smith told investigators, according to a criminal complaint filed Monday.


He definitely doesn't seem to be playing with a full deck, at least from the preliminary reports.

A couple preliminary random thoughts on this...

I can't IMAGINE not IMMEDIATELY calling the police in this situation. ... Maybe he was emotionally crippled afterwords, or paralyzed with fear, who knows... But that was a huge mistake.

God forbid I should ever need to use deadly force in my house. BUT, if I did, I'm pretty sure I would want to make sure they are incapacitated (i.e. dead) too, to eliminate the threat, especially if I knew there was more than one. ... As difficult to digest as this guys comments are, there's a disturbing ring of honesty to them. But then, this whole thing is disturbing... Maybe If these kids were a little older, and not so cute, with a slightly longer criminal record.... Bah, disturbing just the same.

On the ground gasping for air is incapacitated. From there your next move is 911. He didn't do that and it's exactly why he's in hot water.

That guys comments are most likely the most disturbing thing I've ever heard in regards to home defense. None of it rings true here.

I don't necessarily buy that. Not unless he's a doctor, and he knew the guys injury would prevent him from getting up, AND he was able to determine the assailant was NOT on drugs and therefore not 'immune' to the injury.
