NFA Firearms Trust - proposed rules changes

Going the trust route has been a way to avoid CLEO signoff, which can be problematic in some counties. The other advantage, as noted above, has been avoiding the fingerprinting and photograph, and associated background check.

There has been a new "notice of proposed rule-making" coming out of the Department of Justice that, if implemented, would require each member of a firearms trust to undergo a background check, including photo and fingerprints.

The Department of Justice is proposing to amend the regulations of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) regarding the making or transferring of a firearm under the National Firearms Act. The proposed regulations would (1) add a definition for the term "responsible person"; (2) require each responsible person of a corporation, trust or legal entity to complete a specified form, and to submit photographs and fingerprints; (3) require that a copy of all applications to make or transfer a firearm be forwarded to the chief law enforcement officer (CLEO) of the locality in which the maker or transferee is located; and (4) eliminate the requirement for a certification signed by the CLEO.

On the positive side, still no CLEO signoff required. On the negative side, your CLEO would be notified of your NFA registration.

Looks like a little regulatory implementation of the current anti-gun agenda. Opening shot...no legislation nor Executive Order required.

and this would fit hand in hand with the Feinstein Ban, Grandfather, NFA route ...

Yes. Except it can be accomplished with just a little regulatory tweaking. No need to go through any of that messy and unpredictable legislative process.

I heard of this a couple years ago, nothing new. Wouldn't surprise me if the current climate would actually get this through.

My understanding is they currently do background checks of all trustees listed in the trust. Just no fingerprint cards, passport photos, or CLEO signature. At least since they started requiring the full declaration of trust (which lists all trustees), rather than just a certification of trust.

The date listed looks a bit funny to me: 07/00/2013
