Additionally, the City of St. Paul is considering an ordinance that would ban "assault weapons, large-capacity magazines, and binary triggers within city limits."
The Minnesota Gun Owners Caucus has threatened to file a lawsuit against the City of Edina if the city passes an ordinance that attempts to regulate firearms. That warning comes as the City of St. Paul is preparing to vote on a gun control ordinance.

Since the August shooting at Annunciation Catholic School in Minneapolis, elected officials in Minnesota cities have expressed a desire to enact firearm regulations at the local level.

However, Minnesota state law explicitly preempts local jurisdictions from passing their own firearm regulations. In fact, Minnesota Statute 471.633 states that all ordinances from local governments that attempt to regulate firearms are “void.”

We filed suit against the City of Saint Paul yesterday.

St. Paul City Council approves ordinance to ban ‘assault weapons’ within city limits
On Wednesday, the ordinance was approved in a 7-0 vote. Carter, who has voiced support for the proposal, is expected to sign the legislation into law. However, the ordinance itself states that its provisions will only become effective upon a change in the state preemption law.

In a statement to Alpha News, St. Paul City Attorney Lyndsey Olson said “the City is ready to defend our authority to prepare for swift public-safety action—while respecting the rights of responsible gun owners—if state preemption is ever lifted.”

“Contingent ordinances are a common legal tool used in many areas of law, and despite the Minnesota Gun Caucus’s strong rhetoric, they have not been found to violate state firearm preemption law,” added Olson.


Is it a waste of resources to challenge an ordinance that has no legal effect?

IIRC, St Paul's own carry permit scheme is still on the books, despite having been mooted by the statewide preemption. Should we challenge that, too?

What kind of relief is MNGOC leaking in the lawsuit? Just to have the ordnance repealed, or monetary?

In a ideal world, no. But resources are limited, and it's always necessary to choose your fights.

Alternatively, this fight might be a useful fund raising tool.

I have no desire to go back to the pre-2003 hodgepodge of gun laws metro wide....legal in one jurisdiction, illegal in another, subject to permitting in a third, and must be transported with a pretty red bow wrapped around it in a 4th.

Edina gun control ordinance vote put on hold after council discussion - Fox9.com

The Edina City Council was prepared to vote on a gun control ordinance Tuesday night, but Mayor James Hovland put it on hold until there can be a public hearing for residents to weigh in. Even if it were to pass, Minnesota state law says local governments cannot enforce gun bans.


Listening to the mayor, it sounds like he didn’t get the desired, and intended response, so they’ll likely stack the speakers to make for better theatre…..
…..that…and he saw what happened in St Paul….

Edina Mayor James Hovland said Tuesday night he wants residents to be able to weigh-in at a public hearing before the city council takes a vote on it.

He publicly called out one resident who spoke about it is a "leftist political agenda," when gun violence is the leading killer of children in the U.S.

"I was really disappointed in the resident that came at the beginning and seemed to think that it was a leftist agenda to care about the fact that death by gun is the biggest killer of kids in our country. Seven a day getting killed by gun violence, I don’t see where that’s anything but a humanistic sort of agenda to care about the greatest asset we have in our country," Hovland said. "We’ve got to rely on them to take care of all of us, make our country successful. If we’re killing seven a day through gun violence, something is wrong."

The preemption law was passed in 1984, and so was already in place when shall-issue was passed in 2003.

It was passed, mainly, because Mpls and St Paul weren't honoring the state-wide permits issued under the 1975 statute.
