Handgun purchases and non-Minnesota carry permit

Hello there,

I've been doing some research on my own, and I understand that a carry permit allows a Minnesota resident to bypass the need to get a permit to purchase a handgun or "assault" rifle.

The one thing that isn't clear to me is if a valid non-Minnesota non-resident permit with my Minnesota address will count. For example, I have permits from Utah, Virginia, and New Hampshire. Utah shares reciprocity with Minnesota, so would it count? What about the other two? I can't seem to find anything in the law that requires either a Minnesota permit nor a permit with which MN shares reciprocity.

Does anyone have any information or personal experiences?

I'm betting that even if the law allowed such an exemption, the clerk wouldn't know about it and would require you have a purchase permit.

Or you could join the numbers on record here, and get your MN permit to carry. ;)

Some dealers will ask for a state-issued ID or military ID and proof of your address in addition to the out-of state permit.
Its always best to call ahead and get the name of the person you talked to.

Getting a Minnesota permit is definitely part of the plan, just thought this might shorten the process by a bit. :)

My quick read of MN STATUTE 624.7131 leads me to believe that you need a MN permit to carry or a MN Transferee Permit aka Permit to Purchase - unless you want to fill out the forms for the background check at the FFL, and then wait a week for LE to do your background check...

Subd. 9.Permit to carry.A valid permit to carry issued pursuant to section 624.714 constitutes a transferee permit for the purposes of this section and section 624.7132.

Subd. 10.Transfer report not required.A person who transfers a pistol or semiautomatic military-style assault weapon to a person exhibiting a valid transferee permit issued pursuant to this section or a valid permit to carry issued pursuant to section 624.714 is not required to file a transfer report pursuant to section 624.7132, subdivision 1.


While your non-resident permit can be used to carry, it wasn't exactly issued pursuant to 624.714. It's recgonized, based on a review that is ordered by that statute..

I think that 624.714 regulates carrying a pistol in public.

624.7131 regulates the transfer of weapons, so that is the statute that must be followed.

I don't see where a non-resident permit to carry is authorized in 624.7131 to be substituted for a MN transferee permit. The statute says that a permit ISSUED UNDER 624.714 may be used; but again, permits issued by the statutory authority of another state are by definition NOT issued by authority of MN, so NOT 624.714.

This is MY interpretation of the statute, and of course, it may be too conservative.

OTOH, the MN permit to purchase is FREE, and is good for a year, and should only take a week to get...

No, from the people that I know and have tried to purchase with an out of state permit to carry, you need a Minnesota permit to carry or a Minnesota permit to acquire, commonly called a permit to purchase. From what I read here, I see that it all refers to a Minnesota permit to acquire standard, no provision for non Minnesota permits.

If you keep reading, one thing keeps surfacing, a permit to carry is valid as a permit to acquire. But read a bit deeper and it refers to a carry permit that is issued in accordance to certain Minnesota statutes. The permits from other states are recognized to carry in Minnesota, but are not issued in accordance with these Minnesota standards. So valid to use a non resident permit to carry to purchase in Minnesota? I bet that the retails won't guess or want any hassles that can effect their livelihood or pocketbook, they will flat refuse to make a sale under those circumstances

Just to be clear, Utah does not have reciprocity with Minnesota, Minnesota does recognize a Utah permit to carry though.

I would have been very surprised if a non-MN permit was accepted, but you never know. :)

Next step: find a course south of the river for me and my fiancee!

Permit to purchase is free, relitively quick and easy. Nothing says you can't do both that way you can make your purchase and use it for the test part of your class.

Depending on how far south, Cobb is in Mankato and does a very good job, of which you see a hint in his answer to your question.
