Martens claimed that one of the Heller attys came out in support of the mag ban. Has anyone seen this? I goggled all the attys by name and could find no support for her claim. And if she was correct, I would think that would have made big headlines. No?

Robert A. Levy, who served as co-counsel in the landmark Supreme Court case that established a Second Amendment right to bear arms, said there was no reason the court's decision in that case should apply to the purchase of high-capacity gun magazines.

The Supreme Court decision does allow some regulation. And there will be some successful legislation limiting magazines at the state level at least; I think at least CA has a law like that.

Such laws are likely to attract court challenges that a limited magazine law violates the Second Amendment. That is probably NOT a case the pro-gunners want to argue right now. Hard cases, (like the AZ case) can result in bad law.

The magazine law is actually fairly innocuous as gun laws go and I think it's impossible to say the 10 mag limit is unconstitutional without logically invalidating most laws; machime guns, grenades, knifes, backgound checks, age limits, permits ect. (Meaning : right now, we'd loses this.)

Naturally, Gura does NOT want a magazine limit as the next court challenge. We'd really lose momentum. This is his way of discouraging such a case. On the other hand, the Bradys are not as stupid as some of us would like to believe; a case about the constituionallity of a magazine limit law is a wonderful case for THEM right now. But them need GUNNIES to bring such a challenge. And Brady is are trying to provoke such a case I'd bet.

That's why the seized on the magazine limit issue at this time. (IMHO) Let's hope gunnies will NOT grab the bait. 8-) Gura's done pretty well; he's not selling out. It's a smart tactical move I think. We have to deal with the real world.

It seems now to be one of their taking points to say "a permit holder in Tucson almost shot the wrong guy".

"Almost shot"??? Isn't that like being a "little bit" pregnant?

What happened is the permit holder came to the sound of the gun armed, saw a man with a gun (innocent, as it turned out), stopped, exercised his judgment, and took the correct action, which was to NOT SHOOT. Not ALMOST SHOOT. That's a guy I would trust to continue carrying.

Well by that logic, the cops almost shot the wrong guy too.

And I must have almost shot several people this morning on my way into the office.

Didnt the guy say he never drew his weapon?

Doesnt Az still require a permit for concealed carry?

With a lower cap mag he would have to reload earlier giving bystanders a chance to tackle him sooner, Would any of them been in position to do so earlier? The one guy would have still been in the store buying smokes.

Did any of the other mass shootings since the sunset envolve high cap mags?

Ironically AZ still issues CCW but you no longer need one.
