permit to purchase-denial..HELP

OK my buddy and I went to joes sporting good few month ago to purchase firearms and i was clear to buy but he was denied. So they told him to wirte to the NICS for appeal so he sent in his appeal letter. they just got back to him a few days ago saying that he was denied because he was convicted of a felony back when he was a minor in california the charge was vehicle theft they told him that it is a crime of violence in MN. a state prohibitory and for him to go get a governor pardon before he could be able to purchase...does anyone know or been through this or had a similar situation ? also how to get a governor pardon and is stealing a car a crime of violence in MN. ??

I don't know you or your buddy, but a felon is not someone I would want to have a permit, be it a violent crime or not.

I'll be the first to admit I'm pretty conservative and also think felons should not be able to vote(ever) among other rights they should have taken away.

well, to some on here....

First thing you need to do is have yer buddy sign up and write a 3 page story on what happened.
Then you need to ask everyone for their opinion on what he should have done back then.
Then you need to ask everyone for who they should go to for a lawyer.
Then you need to ask everyone for what he should do now.
Then he needs to ignore everyones advice

Yeah....any type of mistake should be punished for the remainder of one's life. The lady that almost hit my car the other day by violating traffic laws, the idiot that litters, those who fail to comply with 922, all the miscellaneous gun laws one fails to comply with, someone even thinking about violent crimes.....take their rights away, we shouldn't even give them jobs. I am sure they will all learn from their mistakes and remain a law abiding citizen if they are oppressed for the rest of their lives. :roll:

I get the whole point of not posting details on the interwebs... But honestly, in this case, it won't make a bit of difference if he spills his guts and posts every dirty detail. Just saying.

Even if the mn state did not classify this as a "crime of violence", there would still be an issue due to the felony, right?

I would be surprised if a lawyer could make anything happen here.

Don't let your buddy near your firearms or you could end up with even more problems.

If the kids true and it happened while a teen, it bothers me a lot that it's following him.

It's My opinon pretty much that this stuff happens, (well, for a lot of us,) and pure luck of the draw divides it from being a story we tell over beer later in life or getting charged out.

I know a lot will say I never did such a thing, but I think a lot did. When does a prank become vandalism? When does a party out behind some ones barn become trespassing? We "broke into" high school one night to decorate a teachers room. One side could call it felony B&E, luckily the officer responding for the call decided it was kids being kids and let us go after a bit.

In this case I do not know the particulars, and unless they dragged the owner from the car and beat them savagely I see a lot of problems with punishing him again.


Have him get a lawyer consult. Have the lawyer tell him the pros and cons of proceeding,

Methinks this is exactly the same type of thread that caused me to walk away from Carryforum, go back to twincitiescarry, and then run screaming from there to here. :mrgreen:

There are vehicles that exist to restore whatever to whomever for whatever. Pursue those channels.

On the face of it (1. Felony record; 2. Permit to purchase denied) I do not have a great deal of sympathy. As to the question of should "punishment" follow someone after they have served their time … the jury is still out on that one (pun intended). There are some that want sex-related felons to be locked up permanently after their sentence expires. Others believe that finishing a sentence ends the issue. Dishonorable discharges are something that follows one for life, and that might be one of the few that cannot be reversed.

But … there are plenty of laws existing that could cover nearly every extingency, including restoration of rights. Failure to follow the steps necessary leaves no reason, in my mind, to complain.

Let the person in question clean their own house and make themselves right again.
