Agreed, The cop was WAAAAY out of line. I'm curious though. Why didn't the driver inform him of the permit immediately? He did have plenty of time. Instead he was telling him about the girl and where he knew her from. The permit holder did not tell him as soon as he could have.

The strange thing is that they searched half of the car before even talking to the driver. "Officer, I do not consent to searches."

Here is what the guy's lawyer is saying about that:

I am representing someone in a failure to notify case. It is an ongoing legal case, so I dont want to post too much here right now. I watched the video today, and it verified an almost unbelievable story my client told me. To make this real brief - my client was stopped. Tried to notify, but was told by one officer to shut up. Another officer came to the driver's side door, and again my client tried to notify. You can hear him in the video say "I've got . . ." before he his cut off with a profanity laced tirade, and demand for his driver's license. My clent hands the officer his license, tries to notify again while holding his CHL in his hand. The officer says "What? What are you waving around that you want me to see?" He takes it, looks at it, while my client says "I'm trying to tell you . . ." The officer asks, "do you have a gun? My guy says "Yes" and then is pushed against his vehicle while the officer takes the gun from my client's waistband holster. The total time from the officer approaching the car door to being told he has a gun was 55 seconds.

It gets worse from there. The officer tells my guy that "I should blast you right in the mouth." "I'm close to caving in your head." "You are a stupid human being." "How would you like it if I pull mine and stick it to your head." When speaking to another officer, he says "I hate these ***** with their gd permits." And, again, later tells my client "I should have taken 2 steps back, put 10 rounds in your ***, and left you lying there. I should have executed you, and I'd go home and sleep good tonight."

No doubt it was a poor set of choices that led the guy to be around an alleged pimp and hooker. Whether he knew it or not (the skeptics in all of us would say "yeah, he probably knew"). Even so, in what way does that excuse the officer for reacting the way he did?

I never saw the guy make a move for his gun, nor heard him make a verbal threat to the officer. I do see a small piece of paper in his hand, and I do see a cop who is at best on a power trip and over-doing it at that. Considering guys like him are supposed to protect and serve guys like me, I'd sooner have the cop "off my side" than I would the PTC holder. If I had my way, they'd both get off my side, but the idiot Cop would have to be first in line. He reacts like he had a gun pulled on him. If that had happened, I'd understand. Sadly it wasn't even close to happening.

I'm in agreement.

Would rather he'd make some half-assed apology to the guy and send him on his way, rather than walk around ranting and cussing for 15 minutes while trying to think of a way out of the **** fest the officer created for himself.

Truly hope his superiors take this incident as seriously as possible. If only we could hope the officer doesn't get the stereotypical "paid time off, wrist slap, and back to work" procedure. Looks like a time bomb to me.

They spend a little time discussing Ohio's duty to notify that you are carrying and how it isn't quite that simple in real life, as we can see from this incident. Another reason to thank Prof. Olson and others for getting our law written the way it was.

UPDATE 7/22/2011: Canton Police announced Thursday that the officer was relieved of all duties in June following an internal investigation complaint filed in this matter. The local Canton Repository has done some additional investigatory work into the officers and an excellent analysis of the video / audio we posted. The video and story has gone both viral and national crossing over to websites not typically affiliated with the pro-gun movement. Shortly after 7:00pm Thursday our website could no longer handle the volume of visitors we were receiving. We promptly quadrupled the resources behind OhioCCW.org in light of the popularity of this story.

And in my opinion, maybe the driver did need a wake-up call to be a little more abrupt with his proclamation of carrying a concealed weapon. A life-threatening wake-up call? No, but a talking to at least.

He tries several times to notify the cop. The cop keeps threatening him with bodily harm if he doesn't shut up.

Charge the cop with Official Oppression. Deprivation of Civil Rights under Color of Law. Assault with intent to cause great bodily harm. Assault with a deadly weapon.Terroristic Threats. Carrying of a firearm during the commission of a felony. Unlawful (and stupid) search of a vehicle.

Currently suspended. As of Monday, on sick leave for "stress" as well. Hence my previous post about his suddenly seeking "treatment".
